    Have you Acknowledged the Claim?: No as I never received it, I received a bailiffs letter instead, I have managed to have the warrant stayed, an I’m attending court on 13 august 2019

    Solicitors Firm: Lowell Solicitors
    Original Creditor: Morses
    Original Debt: Doorstep Loan
    Particulars of Claim: On 5/9/2017 you entered into an agreement for a Morses account. You failed to make payment in accordance with the terms of the agreement and it was later terminated and subsequently assigned to our client by Morses Club on 30th January 2018. Notice of the assignment has previously been given to you and you may request a copy of the agreement on the enclosed reply form. Despite our client’s attempts to engage with you and agree a suitable payment plan, there is a balance which remains unpaid.

    List any letters you have sent: No official letters as I didn’t really understand what I was doing until I joined this forum, now I think I have got it all wrong and made it worse.
    Any Other Information or Background Details: Hi ive been a victim of identity theft an identity fraud an only found this out when a court order telling me the bailiffs were coming dropped through my letter box in march. I panicked as knew nothing about the debt. Phoned the bailiffs office they were a little helpful an told me if i didnt agree with the debt i would have to apply to the courts to have the warrant stayed which would then stop them from coming to my home.

    After applying to all 3 credit reference agencies for my credit reports an relying on google to help me i applied to the courts asking for them to stop the bailiffs from coming. I first filled out the wrong forms then second time couldnt prove i was on benefits so had to get benefits agency to post out letter to prove im on esa. Third time lucky i filled in the correct forms. Proved i was on benefits an wrote a short defence on the form stating the debt wasnt mine an that i had been a victim of fraud. My credit file is full of unknown debts. Experian agreed i had been a victim of fraud. I contacted various companies including lowell solicitors using letter templates from national debt line explaining my situation. Cabot financial accepted my situation an cleared the debts an removed thrm off my file.

    Lowell have point blank refused to believe me or help me. The courts agreed to stay the warrant an gave me a court date for the 13 aug 19 to attend court. Im not certain as to why until i got a 30 page letter from lowell solicitors putting across their arguement as to why the warrant should be put back in place an for me to pay them the money owed.

    The only piece of evidence they have provided is a copy of the loan agreement with what looks similar to my signature on it and copies of all the letters they sent me that i never recieved. Mainly cos they had got my address wrong. The paperwork they have sent to the court is addressed to the wrong court an my name is spelt wrong. They have only just corrected my address recently i imagine so they can say to the courts its been right all along. The letters they included in the pack shows different.

    I suffer from depression an anxiety an ptsd an this is scaring the hell out of me. I have a lowell financial debt and a BPO debt still to deal with. They are threatening court action. But i can only deal with one thing at a time. I have tried to deal with all this on my own by following the way national debt line says to send letters etc. Asking for proof its my debt etc. But im not winning.

    Im begging for help. These debts are not mine. I can prove my google maps timeline that i wasnt at home at all on the day the loan was taken out from morses club plc. The only other person who could have done this in my name would have been my sons ex girlfriend. Who 9 weeks ago moved out robbing my house in the process. Leaving behind debts in her name. Please i need help.
