  • Court claim from "Arrow Global Limited"

    Hi everyone. So I've received a county court claim form and I feel sick to my stomach, and very frightened. Can anyone advise me on what to do? I was reading the forum rules and in accordance with them, i supply you with the following info:

    Received a claim: YES

    Issue date: 26 JULY 2019

    Have you acknowledged the claim?: Not yet (just received it through the post today)

    Total amount claimed: £1130 (including court fees and legal representatives costs)

    Claimants' name: Arrow Global Limited

    Solicitors' firm: Drydens Limited (Leeds)

    Original creditor: NewDay Ltd (Aqua credit card)

    Original debt: Credit card

    Particulars of claim: "A default notice was served upon the defendant and has not been complied with."

    Is the debt Statute Barred: I'm not sure, but don't think so???

    List any letters you have sent: None recently - and don't remember last time I did

    Any other information or background details: Can't remember last time I paid anything towards this debt or when I last communicated with the original creditor (Aqua) or the debt collection agency (Arrow Global Limited).

    I'm very worried, and there is no way I can pay off this debt. I am a full-time higher education student, currently off until the next term starts in September and working for an employment agency doing odd days of work here and there (not earning enough to pay off this debt). I will only be working for the agency until I go back in September, after which time I will not be working and will be studying full-time.

    What can I do? I'm so worried and afraid.

      If I do this, which I will, what should I expect to happen? They send me these documents I request, and then what?

      There's no way I'm going to be able to pay any of this - will I inevitably have a CCJ lodged against my credit report?

      I'm really very scared.

        Once you have acknowledged and sent if the CPR Nd CCA letters as detailed by Mike above there will be a period where you can look at the claim and, if it doesn't seem you would be able to defend, look at making a monthly instalment offer based on your circumstances.

        Have you any idea when you opened the account or when it defaulted ?
