    Im not sure what copies of evidence i even sent them (sorry), but i do know i had some stuff pre prepared , specialist letters, a letter from the facility i was in (around the time of this debt) etc etc.

    I remember Lowell's sending a letter looking for medical evidence to support my claim of illness. but i've lost that too.

    The original claim is for a Shop direct bill balance 408 gbp. I don't remember getting any stuff to my home. Then again i was very ill at the time.

      Not a problem, things happen and paperwork gets lost and ignored because tbh, life becomes more important.

      Once you have sent in the direction questionnaire you should send the claimant another letter - CCA Request
      .

      You should also send a Subject Access Request to Shop Direct for information about the account and purchases, just so you can rule out that it may be fraud.

      Although mental health issues should be treated sympathetically and they should allow for such issues when dealing with a debt, it wouldn't stop them obtaining a CCJ against you.

      Where do you stand now financially with regards making an offer to pay the debt by instalments over say the next 12 months? ( about £40 a month )? You could make an offer without prejudice ( ie out of court ) and ask them to put the court case on hold until it is paid off, or you could look to offer instalments at mediation.

        Could not afford 40 a month , being hammered left right and center, CT, Marstons(a pcn for a car i sold), Lowell's. Never ending.

          Everythings piled up a little hasn't it - have you discussed things with anyone ? CAB might be able to assist - particularly with CT and Marstons - getting your IE sheets sorted, letting creditors/council etc know of your health issues should at least get an affordable payment plan sorted out. Worth getting an appt to see them to sit down with everything and get a plan together so you're back on top of things xxx

            Ok thank you for your help, will keep you informed of what happens. Yes things have piled up, been a rough few years. Bereavments, health etc etc etc....Life. Will sort it though.

                As someone who has mental health issues also all I can say it is important just to take one step at a time & try not to worry about the "what happens next stuff".

                Open all your post & just go from there. Try not to worry day in day out. The process is several months long but only has about 5 or 6 stages for you to complete.

                Of these stages only the defence & witness statements take effort.

                    This declaration must be sworn before a Commissioner for Oaths (e.g. a Solicitor), a Justice of the Peace (at any Magistrates Court) or an officer of your local county court
                    Yes A solicitor usually charges a small fee for doing it.

                    I'll tag ploddertom for you as I don't know much about this area and don't know whether a statutory declaration is appropriate. Is this for Marstons? and they are chasing a magistrates fine for a traffic offence?
