Claimant threatening summary judgement on stayed ccj claim. Should I reply?

      TBH it's unlikely your statement has been read as the other side have been struck for a procedural point ( non payment of the hearing fee ) rather than their lack of paperwork to evidence their claim or any of your defence points. Did they send you a witness statement at all ?

      • I got another letter from the court last week stating that the claimant had until xx sept to fulfil para x of order dated xx or the case would be struck out. That para referred to making witness statements to the court and myself
        they still have apparently a week on that one..then I got today's letter

        • I probably won't chase for costs..I know it will only be chump change..but I would like to know if it would have been possible

          • Well they have run the whole case as an afterthought so it's not suprising. Let's hope they know when to call it a day xx

              Costs are usually actual losses like earnings for an unpaid day off work to attend court, postage and parking etc. and so you might get something, but the risk of spending £255 chasing wasted costs due to unreasonable conduct and failing really isn't worth it in my opinion, sometimes it's better to just walk away and chalk it up to experience.
