  • Court Papers issued in incorrect name HELP!

    I received court papers in December for an issue relating to my Limited Company which still trades, however the court papers have been issued in my own personal name C/O my business name (does not say limited on court papers) and also sent to my home address rather than my business address. I submitted a defence stating that the contract with the client was with a limited company and provided a copy of the signed contract.

    I then received a directions questionnaire, so I called the courts who also confirmed that it looked like it had been incorrectly issued and I should send an email through to the courts to clarify everything..
    I received a response to my email yesterday and they have confirmed that I should submit the questionnaire but include a cover letter for the district judge, again explaining the situation that I am a limited company.

    So today I have sent off the directions questionnaire with my cover letter. However, I feel no one is listening to me and proceedings seem to be going ahead regardless!!
    Does anyone know the likelihood of the outcome? will it be thrown out before it gets to court? or will it ACTUALLY make it to court?

    If the claim is issued again in my business name I will be putting together a defence but surely I shouldn't be submitting that as a defence with this particular claim?
    Any advice would be much appreciated.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
