Hello. We are in Scotland and have faced a similar issue to Humza Yousaf (see link below) in which our children haven't been given a place on a nursery's waiting list because of our names (multiple fake accounts with British-sounding names were given a place in the waiting list immediately). We complaint to Care Inspectorate and they have upheld our complaint. We are very confused but we were advised we could claim costs due to injury feelings due to nationality discrimination. Our evidence are emails from nursery denying us a place and accepting other (fake) children for same starting dates and week days. Could I please ask you:
- does this sound likely to prosper in court?
- how can we decide which compensation to ask from the nursery?
- will the court take into account the emails for the fake British-sounding parents/children that constitute our main evidence?
Time is running out as I understand cases of discrimination should be 6 months since the incident, and the first one that we were denied a place was in October.
