Last year I accepted a job to work abroad in the USA for 10 weeks, doing camp america.
While on the job, I felt threatened about the location I was in as I saw numerous things such as a big burnt cross, confederation flags, guns and people looking at me in an odd way. I suffered a psychological issue back in 2018 which i fully recovered, from the doctors notes, but being in the USA I felt my mental health was being affected badly, having panic attacks, so decided to come home.
The company are taking me to court as I did not work out my full contract
The company have contacted me for breaching the contract and owing a big amount. In the contract they state
"If a participant returns home early for any other reason than serious injury, or death of a parent or sibling, they will be in breach of contract and the participant will be charged 1 week salary for each remaining week of their contract. e.g. if a participant leaves 4 weeks early then they are in breach of contract for 4 x weeks salary. The participant will also be required to pay their flight change in full - how much is dependent upon the airline and availability before any flight will be changed. If a coach does not pay for the flight change, then the change will not be made as quoted and further quotes may be of a higher value. If during this time hotel accommodation is needed then "COMPANY NAME" will cover 1 nights accommodation which will be from the last day the coach works and then the coach will be responsible for accommodation thereafter."
Have I found a loop in this statement as when it states "serious injury" in the first line, it could mean psychological as well? or would that be dismissed in court? In the terms and conditions they do not mention mental health at all and nothing to do with the well being of the coach unless he acts inappropriately, injured or damages the brand name. When I returned to the UK I saw my GP and he had written a letter and it states" I can confirm that there was no medical reason why he should not have applied for and accepted the coaching contract. He had no reason to suspect that he might become psychiatrically unwell while in the USA".
