  • Sub standerd work - Tiler claiming againt us!

This is the first time I've ever had to do this! So stressful! If anyone can give me some advice it would be much appreciated. We used the services (labour only) of a Tiler, who's workmanship was sub-standard. and didn't follow any instructions given to him. He was paid 3/4 of the total under duress. He did not come back to finish in the agreed time and has refused negotiation when my partner stepped in. Referring all communication via his wife. He has filed a money claims against me. The claim has one name on it and that is the wrong name and does not include my partner? However I filed for defense and heard nothing. Two weeks ago I noted on the Online MC that the court had closed the case due to the claimant not proceeding before the date stated. On Friday 29th Nov 2019 I received a county court letter, immediately I phoned the OMC, to which I was informed that the OMC website page was showing an error! and that I needed to send a Directions questionnaire (Small Claims Track) in by the 4th Dec 2019. This form was then emailed to me on request. It has subsequently been posted but has left us with no time to acquire any written evidence by another professional tile/s (we can provide 3 quotes for remedial work and for a total redo). Is there any redress because of the shambles the OMC has made! And what happens next?
