Can I Apply for the Claim to be Struck Out?

I obtained an order for the claimant to clarify his Particulars of Claim.

The Claimant's solicitor has sent an Amended Particulars of Claim. But the Claimant's solicitor has also sent in an amended Claim Form striking out the claimant and changing the name of the Claimant to another company.

I emailed the court and they have replied that the Claimant has not filed an N244 or paid the fee to get the name of the Claimant amended and the claim reserved.

Can I apply for the claim to be struck out as they have not filed an N244 Application to change the Claimant nor paid the court processing fee.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
