Hoping someone can help.
I have received a part admission for a small claim I have raised, which I am about to accept. The claim is against 2 defendants (male and female).
Looking at the N9A and N9B form I have received, it appears that only 1 of the defendants has responded. The forms are in her name only (ie the court filled in area at the top right hand side of the form), have only been signed by her alone, and only her address is given (the defendants live at different addresses).
However in the N9A form, under personal details, she mentions the other defendant so the form reads Forename Hers/His. Yet again the form is in her name alone, she only gives her address, her income/expense details and her signature.
I believe this is not adequate to qualify as his response, as he needs to fill in his own N9A and N9B and I can therefore go ahead and get a ccj against him whilst accepting the part payment for her?
