  • Civil recovery NCBS and house of fraser

Hi, my husband received an incomplete order from House of Fraser last Christmas, who refused to refund for the item missing from the delivery, so we had our credit card company complete a chargeback for the amount of the item. We received a notice of civil recovery from NCBS, and after replying to their message asking they provide evidence, they sent back some photos, which were not exactly proof of the item being included, just that the item was picked up and held next to the packaging. The packaging itself from one photo to the next looked exactly the same, while it should have shown a significant increase in size with a jacket being added. In addition, our original photos of the items and packaging delivered show that the puffy coat could not have fit into the original delivery package. My question is, could someone advise how I should respond to their second message with this questionable proof they’ve provided? They have closed their email with this:
We await the outstanding amount owed in order to close your case and take no further action.

In any event that your case is pursued, further fees as stated under Section 69 of The County Courts Act 1989 will be incurred and will be reflected within the new balance.

Should I be concerned that they will pursue it further, and possibly take us to court? Any advice would be greatly appreciated. Thank you.

Just wondering if anyone could advise on how I can reply to this NBCS company on this communication they provided some poor quality photos that still don’t show the item being packed in the delivery?

Sorry, your first post seems to have been missed

Suggest you read this thread (https://legalbeagles.info/forums/for...ouse-of-fraser ) which deals with a very similar situation.
