  • Will anything from RLP show up in Civil Litigation checks?

    Hi,

    About 5 years ago I was in a mental health episode and wasn’t in my right mind. I have since been hospitalised and have found a medication that works for me, so, my head is screwed on properly again for the rest of the future.

    However, during the episode, because I was seeing and hearing things, I ended up walking out of a shop with some items. I was interrupted by security and they sent an RLP for me which I ignored.

    To be fair, they got everything back from me untampered with so the RLP was pretty unfair - I hadn’t damage any of the goods. The police were involved but did not fine me- it was a first offence and I was advised to seek mental health help.

    The RLP was just bullying me because like I say, they got everything back. The amount they were trying to claim
    from me was extortionate and I didn’t have any money at the time.

    Like I say I ignored the RLP and was due to move address in a few months anyway, they don’t have a new one for me.

    I’ve come across something called “civil litigation checks” which are sometime conducted as pre employment checks. This check is for a range of different type of court related incidents of an individual- someone with legal knowledge would understand them, I don’t however.

    I dont actually know if the store tried to take me to court or not but I haven’t got any CCJs on my credit rating.

    Does anyone know if something from this whole RLP thing would show on a civil litigation check when I don’t have a CCJ?

          There was no civil litigation following the shopping incident, so there is nothing to show on a check.

            Thanks for your advice. I’m still a bit concerned - I have read the following about civil litigation checks :

            ”Civil litigation searchUsing civil court records, we'll check whether an individual has been involved in civil litigation. Depending on the court, the search may include details of CCJs, High Court judgments, tribunal awards, small claims and summary causes and default money judgements.”

            I’m just wondering, if they had started a claim against be but were unsuccessful- for instance the court decided to not pursue their claim - would there be some record of it - that it was registered but did not become anything.

                    I’m looking at job applications and some of them require this type of check. Potentially yes someone would be carrying out this check of me

                          I found some more information about it;

                          What does it check?

                          Using civil court records, we'll check whether an individual has been involved in civil litigation. Depending on the court, the search may include details of CCJs, High Court judgments, tribunal awards, small claims and summary causes and default money judgements.

                          This UK wide civil litigation search covers court cases registered against the individual as a defendant. This register does not include information on claimants. The search covers all of the following:

                          County Court Judgments are held on the register when the judgment has been issued in default (i.e a judgment without trial where no defence was entered) or else defended and payment is by instalment order, or where enforcement action is being taken.

                          High Court Judgments are held on the register when the judgment has been issued in default (i.e a judgment without trial where no defence was entered) or else defended and payment is by instalment order, or where enforcement action is being taken.

                          Tribunal Awards Details of tribunal awards relating to individuals, companies and businesses where action has been taken to enforce the Award.

                          Administration Orders against a debtor with at least one CCJ registered against who has made an application to the court for an administration order.

                          Fine Defaults Details of unpaid fines imposed by magistrates & crown courts are registered by Magistrates Courts.

                          Child Support Agency Liability Orders normally relate to self-employed individuals as no Attachment of Earnings Order can be made in these cases to enforce a judgment.

                          Scottish Registers contains details of undefended money decrees submitted in the Sheriff Courts as either small claims, summary, ordinary cause or simple procedure.

                          Republic of Ireland register contains details of money judgments which have been registered at the Four Courts in Dublin in order to be enforced.

                          Isle of Man register contains details of default money judgments and defaulted fines recorded by the General Registry of the Isle of Man Courts of Justice

                          Jersey register contains money judgments for registrations in the petty debts and royal courts in Jersey.

                          Northern Ireland register contains details of all undefended default and small claims money judgments and high court judgments registered in the individual county or high courts or at the civil processing centre.”

                          As far as I understand this I think it’s a no, there will be nothing come up on a check against me but I just wondered if anyone understands anything else about this
