  • Without Prejudice letter from bank re a Section 75 claim

    I made a Section 75 claim to a bank re a holiday wherein we didn't get what we paid for and the holiday was not as described. The bank emailed me on 28 June rejecting my "chargeback request" and inviting me to go to the FOS if I wasn't satisfied. I complained to the FOS that the bank had ignored my Section 75 claim and instead dealt with the matter as a Chargeback request. Today I have receive a 26 June letter from the bank rejecting my Section 75 request. The letter says "This offer letter, its terms and the negotiations leading to its conclusion are confidential to the parties except where disclosure is required by law or statute". The letter does not say this is the banks final decision or that I can go to the Ombudsman if not satisfied. The letter is headed "Without prejudice save as to costs". Both the email and the letter offer me the £200 I paid to get home from an airport other than the return was booked to.

    Can anyone explain please why the letter, why the email invited me to complain to the FOS but the letter doesn't?
