We had a glass lantern roof installed last year (in England). One evening we heard what sounded like water rushing out of a burst water pipe, then what sounded like a down pour of hail storms, then the whole panel shattered and came falling down...luckily nobody was out there at the time.
This has happened within the first year of the work being done and product installed.
We have contacted the company who supplied and fitted the glass but they are citing a clause in the contract to say they are exempt from paying for the glass to be repaired:
8.1 [Company] undertake to repair or replace the product or part of the product free of charge for labour and materials from the date of order if the product develops a fault due to defective materials or construction.
8.2 The period of this guarantee is ten years on frame materials, manufacturing and all work carried out by [Company]. The period of guarantee is ten years on the sealed double glazed units but excluding actual glass breakage.
Are we in any position to argue / fight against this? Is there a way that we can prove that the issue is due to poor quality glass / wasn’t fitted properly / was defective?
