Got a legal question for you. My friends caravan holiday is booked for the first week JLR (works) summer shutdown, last week in July, first week of August 2020. It’s looking likely that won’t happen but not implausible that we could still go. Right, the holiday firm “St Ives Bay Holiday Park” have said if they are not open by then we can’t have our money back and have to have an holiday with them next year. This is part of their booking conditions in clause 7. This states if circumstances arise from act of god (force majeure)they are not liable for “damages”. Now, I relate “damages” to something that may happen to us or our possessions while on holiday there and not the fact they are not able to open and supply our accommodation which is clause 5.
Basically if we can’t go this year we have to go with them next year or lose our money for the holiday which we are still paying.
