      If everyone joined Santander based on them finally doing one decent thing, wouldn't that in fact justify all the other rip off they engage in?

        lol @ dark forces. none here

        this Judicial Review is the banks not wanting the FSA to gain the right to retrospectively apply rules, and I agree with them. It isnt about the legality of PPI and so on. PPI was missold due to the banks not complying with the regulations in force at the time it was sold - so there is no reason why claims should be on hold.

        The only thing that they might be doing is because the retrospective rules are coming in in December (barring the JR winning) the banks are paying out to those higher levels (ie as if the rules were retrospective) now as opposed tohaving to go back and review the claims in December, so in my mind they should just stop doing that, and continue processing complaints.

        And remember whatever is 'on hold' the FOS isnt putting anything on hold.

        So basically i agree with the banks taking a Judicial Review to clarify if FSA have the power to apply retrospective rules, but disagree entirely that claims should be on hold at all.

          That makes sense.

          But, can you not see this as some sort of set up by the FSA to help there mates over at the banks?

          Make some really tough rules and give the banks an angle to force claims on hold, whoever loses the JR will appeal, clearly... so this hold will go on for years.

          It's such an obvious fix imo.

          right now, they know, just like you suggest.. nobody is bothered.

          so.. as per usual... they get away with it.

          i am not backing santander... more using them to highlight a big stick to beat the others with and show them that we can unite and make a difference,

          cleary... VERY clearly we can't

          which is why they win, every time.

              You are simply kidding yourself that anyone would migrate to Santander - the worst bank in the UK - on a point of principle. And this site would be delinquent in it's responsibilities to it's members in encouraging it.

                  maybe i am kidding myself, but i am trying to think of ideas to beat the duff banks with.

                  they are going to run amock with this legal case for at least 12-18 months

                  FFS, you think they will just give up at the high court?

                  hahahahahhaha

                  Supreme Court 2012 here we come.

Might not be placard waving or boycotting but at least it has a real effect (and yes we'd just be one of many but all views are taken into account as seen by the OFT PCC consultations etc and its better to have a small voice than none at all)

                        Alternatively you can give your views in a simple online questionnaire - with questions like ''Do you think that the level of charges for going overdrawn on your account are fair?''

                          Customers won't receive any redress until banks' judicial review is heard.


                          Thousands of customers who have complained that they were mis-sold a payment protection policy face lengthy delays to get their claim resolved, after a legal argument between the banks and the Financial Services Authority.

                          However, those affected by these delays are being urged to take their case to the Financial Ombudsman Service – which is still dealing with all PPI complaints and is ruling in the customer's favour in most cases.

                            Consumer groups urged those people mis-sold PPI to be persistent. Ms Lipszyc said: "The FSA is facing a revolt from those it regulates and it is understood that the regulator is considering strong action." She said she understood the FSA was considering whether to file an injunction against the banks.
