  • Re: Latest updates on PPI Judicial Review and claims on hold

the more i look into this, and the more i understand about the new rules and the actions of the fsa and bba...

the more of a set up it looks

the current reclaim system is fine, the banks had no angle, no room to manouvere and have been paying out millions

the fsa gave them this angle, that is a fact i am positive about.

like the man said above... they are all in the same racket.... pimms, sir?

Battle hots up over PPI mis-selling claims

        Thursday 14th October 2010:

Fresh battle lines have been drawn up in the battle between banks and the FSA over the mis-selling of Payment Protection Insurance.

Barclays has put on hold complaints alleging mis-selling of PPI, in view of a legal challenge to the FSA.

This is the FSA's consultation paper of March this year which formed the basis of the new rules which come into force in December.

          http://www.fsa.gov.uk/pubs/cp/cp10_06.pdf

The summary of responses from the PPI industry (at 1.13) broadly indicate some of the issues the banks are challenging in the Judicial Review.

It's incredible that even at this stage the banks were in complete denial of the scale of the entire PPI isssue:

Responses from industry were almost exclusively negative about our proposals
          arguing that we had:

          • not demonstrated that there was a genuine problem around PPI sales or around
          PPI complaint handling....

This was justed posted on MSE from someone who has posted before helping us and I would say is a very good source of information and knows his stuff

The act of parliament, the Regulated Activities Order, 2000, for financial services has very strict behavioural rules for the owners of firms who hold more than 10 or 20% of shares. The FSA refers to them as Controllers. In the case of Lloyds and RBS the Government is the Controller and should be asked to state why it supports the PPI complaints freeze. No bank should be able to request a judicial review without the support of their largest shareholder No doubt the Gov will claim some obscure exemption but we should write to our MPs and demand an explanation. (This was not possible for bank charges as it is not a regulated product). Will the FSA ask the Gov/Controller to explain?

is there a difference between here and there?

can get confusing as to who is on what side and what other site we can or cannot talk about

                        From Lloyds Banking group site

                        RESPONDING TO CUSTOMER COMPLAINTS

The vast majority of our customers are happy with the service we provide. In relation to the high number of accounts we hold, we receive a relatively low number of complaints.
When we do receive complaints, we take these very seriously, and ensure that they are dealt with fairly, quickly and consistently. Wherever possible, we aim to resolve customer complaints within five days. We increased the number of complaints resolved within 5 days by our specialist back office teams by more than 30 per cent between May and October 2009.
However, we know we have to work hard to reduce the number of complaints we receive in the first place if we are to achieve our goal of becoming the UK’s best and most recommended bank.
At the end of 2009 we rolled out a new complaints system that will help us capture complaints data and conduct analyses of the root causes. Understanding the root causes of complaints will help us tackle them. We are also working to improve colleagues’complaint handling skills by delivering new training, development and communication in 2010 for all customer facing colleagues. We are currently testing a number of initiatives that will increase the ability of frontline colleagues to resolve complaints there and then.
From August this year, UK banks will be required to report their full complaints data publicly under new FSA rules. We welcome this initiative as it will greatly increase industry-wide transparency around customer complaints for all stakeholders.

Absolutely no difference whatsoever, as Amethyst says we're all on the same side.

                            To reiterate, anyone who has concerns re this matter, needs to complain to their MP;
                            get the MP's involved!

Also, involve CAB & Which?, both have made super complaints re: the mis-selling of PPI.

ok what about the likes of northern rock, egg, ge money.... and others who face ppi complaints?

as they are not part of the action taking place, surely there complaints should continue?

maybe we need to clarify this so as not to put people off claiming against those types.

                              anybody know?
