    Hi, I need alittle help if anyone can so here goes,

    I sent a letter (the one u d/l) to Halifax saying I wanted to reclaim the £2270 of charges they had from me, they said it was suspended blah blah, but now I need it I have had a few more charges since and am £300 over my £650 overdraft. I also have fines that amount up to£300 from other things like parking that shouldve been paid along time ago, i have about £9000 in loans and credit card which are bieng delt with by a debt mangement compony and I am 2months sort of £500 rent so £1000 for both months, plus my car has just been taken to the scrapyard as it broke down and I work 13 miles from home.

    As you can see this is pretty bad do you think if I explained this to my bank for financial hardship they would look at my case if so what would be my best bet to go about it?.

    Best bet is to write a letter to Halifax headed Financial Difficulty - Complaint about Bank Charges, explain everything you have put above, that the bank charges are making things very difficult to manage at the moment, explain rent arrears, civil fines etc. Tell them that you already sent a letter and that the charges incurred have increased since and what the current total is, include an income and expenditure spreadsheet ( Legal Beagles ) and if you can send a spreadsheet detailing the charges you are claiming ( Legal Beagles ) and ask them to consider your complaint under the waiver exemption.


    Also tell them what action you are taking (like entering the DMP) to make things better. It might be an idea to pre-empt switching to a basic account (as they are likely to recommend that) and moving your essential direct debits etc over - also you can tell them that as the overdraft on the account is made up of charges, you'd like to arrange an interim repayment plan on the overdraft outstanding and have it passed to collections - this will make it much easier to manage, stop it increasing any further and show you are making efforts to sort things out.

    If they won't pass you to collections then open a basic account elsewhere ditch the overdraft and then they'll have to deal with it. If you are worried about a mark on your credit file, you should be able to get anything removed later once the charges are legally unfair and really a bad mark is better than sinking in never ending spiral of bank charges and debt.

    Have a bash with a letter and post it up and we can give you a hand.

    If you look in the stickies at the top of this forum ( Hardship Claims - Legal Beagles ) theres some good examples of other peoples hardship letters ( that have won )

          Hi, this is my letter i'm really no good at this so probably might want to change alot. i have'nt done a spreed sheet yet are there any examples on here ?

          I'm ok thanks, have to stay at my mums for the time being.

              Hi,

              I'm looking at the spreedsheet example and i think even though the situation im in, i dont think i'd qualify for the hardship rules.

              Because now i have gone back home which i no longer have to pay the £1000 rent and with out a car my outgoings have gone down, even though i owe people money for other things like Loans, fines and im in my overdraft cuz of me being home and car-less it looks like im bringing home £1000 per month but only spending £500- £600 on it allso leaving me with £400 per month.

              I'l upload my bit of spreadsheet i started so u can see what you think.

                  I have a few more for you to consider. Please do not give up until we have fully completed the I & E and we can access the overall situation.

                  You say you have debts can you please list these and are any of these taking you to court?

                  Is the monthly income you quoted of £1010 your net or gross?

                  The TBA monthly figure for fines what is that likely to be?

                  What is your food costs per month?

                  Is there a monthly car loan payment?

                  Is there any parking costs?

                  Car repairs & MOT?

                  Medical costs, ie Dentist, prescriptions etc?

                  Clothes & Shoes?

                  Presents?

                  Bank Charges?

                  Loans?

                  Other debts?

                    Here is my update on the letter and spreedsheet.

                    As you can see i have said im £300 over my overdraft do you think i should say to halifax that if they didnt refund me then i would pass that on to my debt management, because if they did refund me i would pay some mabye even all of it with the refund, so in a way they would be getting it back.

                      Food and groceries must be much more than £20 a month?

                      There are still some expenses to put in Clothing and shoes, Car repairs, presents.... etc etc..

                      It is also good to show that the expenses exceed the income.

                      Your letter is looking good, but you also need to include all your evidences of the eviction and what has to be paid, copies of bank statements showing your charges and details of the debt managment, showing the £150 per month which you are paying.

                        I have a copy of 2 letters from my landlord which explains i was in arrears and i got evicted and owe him £250, wage slips, debt management and bank statement letters i got i can photocopy them and attach them...would that be a good idea ? i would have to mention that in my letter too.

                          From our experiences with hardship the better you package it the better, it saves them coming back for more info.

                            I have on put my phone bill as £45 cuz thats what it should be but this time it was £128 and time before was £71 should i add that or is that just my own fault

                              Ok, i have change it all, take a look....there is some thing im just waiting for, i am expecting that because my water and council bills were cut short i might have to pay a cut fee i will find that out tomorrow if so then i will add it.
