  • Hardship case assistance please?

    Good Evening

i am currently in th process of claiming my overdraft charges back through financial hardship. i have sent a complaint form to the financial ombudsmen (who have acknowledged receipt). basically i had a letter today off my bank asking for me to call them as they have been trying to contact me. i did and basically it was about offering me an overdraft facility (what i had complained about to ombudsmen).

they said it would be credit scored. which i know i will fail.

my question is - do you think this will have any affect on my hardship claim.

it smells fishy to me - they have never done this before now.

    any advice welcome please.

A Warm welcome to Legal Beagles, which bank is it?
Did they say that they had accepted the overdraft?

      HSBC

they offered me an overdraft - did not apply as 1 knew would fail credit score and 2. seems suspicious due to complaint with ombudsmen

I think it was coincidence to be honest but ouch, HSBC can be real hard nuts to crack.
I may be going over old ground but can I check whether they took an income and expenditure form?
Have you got priority debt arrears(mortgage/rent, council tax, utilities)?

Hi and welcome to Beagles. Sorry to be a pessimist but if the £500 charges in 12 months is the only part of the hardship waiver that you meet, I don't think you'll get very far. When looking at hardship they take into account the whole financial siuation. Unfortunately you'll probably have to meet more of the hardship conditions before you get anywhere with them. If you are managing to keep your head above water it will be tough, IMO, to get a payout on hardship grounds.
Fill in one of the LB I& E sheets and post it up.then we'd have more of an idea of your situation and be able to advise better. If you don't want to post in the open forum, email it to one of the team.

Looked at your IE as requested by Nattie.

                    Thinsg that stick out

                    No child benefit on there

One of you is off work - yet you are paying £600 a month childcare

Food/Housekeeping is far too low - should be around £360

Car Insurance seems quite high but nothing new there....also travel & fares of £40 a month WITH petrol of £100 would be considered too much.

Subscriptions - whats that for - usually considered a luxury tbh.

Any other debts - credit cards/loans/overdrafts/utility arrears etc ?

If we can sort those bits out do justification I can translate it over to a CFS sheet (the one the banks use) will need to go through a few more bits but if you can answer the above points first that would be great.

As Nattie has said HSBC and hardship don't mix.....deaths door cardboard box before they consider you. grrr.

You could be entitled to further help of £84 a week from tax credits.

As you know you won't get help with childcare while one of you is working less than 16 hrs.

DO you want to make those changes and reupload the spreadsheet IE. Put your catalogue debt in non priority debt. The nil balance things leave off.

From what you have said thus far I don't think you would be classed as in hardship.
