        I do believe that this PPI has been mis-sold and I would advise reclaiming it.

        MSE have a good guide that will help: PPI Reclaiming Guide: Free template letters to get £1,000s back on loan insurance....

        As TT points out the "default" notice is meaningless as there certain things that MUST be included in it to be lawful.

                I have been through all the papers I have with a fine tooth comb, the above posted default notice is the only one we received. I'm off to the docs shortly as I am now barely sleeping at all and can't think straight:cry: Sitting around crying isn't going to get this sorted, so I think I will have to go back on the meds again for a while:tinysmile_cry_t:. Could someone point me in the direction of an explanation of what a S18 is please I don't full understand what it is thanks guys

                    Just a further thought - I really am sorry to keep harping on, but it's the Terrier in me!

                    This extract is in the Judgement in London and North Securities - v Meadows and was before:
                    THE MASTER OF THE ROLLS
                    LORD JUSTICE WALLER
                    and
                    LORD JUSTICE LLOYD

                    'Items excluded from total charge for credit
                    (1) The amounts of the following items are not included in the total charge for credit in relation to an agreement
                    ……
                    (c) any charge relating to an agreement which is an agreement to finance a transaction of a description referred to in paragraph (a) or (b) of section 11(1) of the Act, being a charge which would be payable if the transaction were for cash;
                    ……
                    (j) a premium under a contract of insurance the making or maintenance of which is not required by the creditor as a condition of the making of the agreement.”


                    It follows that we dismiss the appeal (by London and North Securities) because, if the insurance premium was part of the total charge for credit, as we hold, then the amount of credit under the agreement was incorrectly stated. It should have been stated as £5,000, not £5,750. It is agreed that this is a breach of the Act which cannot be overcome.'

                    It really is worth examining the original contract in EXTREME detail...I think!

                      It is all kept seperate on the paperwork - the ppi could have been paid cash but instead was paid for with a loan which details a seperate interest amount. If the PPI had been included in the charge for credit then yes I would agree that would have made the enforceability an issue, but it isn't it's seperate throughout the agreement and states its optional.

                            well looks like the expected you to just take default judgement. So you scuppered them gaining judgement on 13th by acknowledging.

                              Curly, can you look at the agreement, and see if you think the total charge for credit is right? It just seems to me that a total charge for credit of £15k is wrong. they seem to have put the total repayable in the total charge for credit box incorrectly. I wonder what the implications of this are? Can't look it up at the moment.
