I have received the following letter from Nemo which I have to confess is worrying me (just a little) Are they trying to move the goal posts, and can they actually do this now it has gone through the court?.....

"In view of the fact that your loan is now no longer secured, Nemo has taken the decision to transfer the handling of your account to Link Financial Ltd. Link specialise in this type of debt and they will be in contact with you shortly to discuss your financial situation and to agree a repayment plan with you."

I thought the judgement from the court was the repayment plan? I am rather confused now.

I would have thought that the court judgement was it. I would sit tight for now and see if anything comes from Link. Then if and when it does get CB on the case and tell them where to get off. Or you could just write back to Nemo ponting out that a repayment plan has been agreed by the court so they can pass it to anyone they like and it won't change matters. Not sure if this would be a good idea though, depends if you want to poke the tiger with a pointy stick or not.

            See what others advise.....

What exactly did the judgement say, as you never posted it up.

Yes thats it - you have a court order saying you must pay £100 per month to Nemo Personal finance. If they want to vary this order at all they must go through the courts.

Make your payment to Nemo as the court has ordered, and deal with anything that might come up if it does.

Actually could you scan in the Nemo/Link letter too? They may just be using link as a collections vehicle. Even if the debt has been sold on (which they can do) no new DCA/collections agent to has any right to vary the terms or payments ordered by the Court unless a Variation/Redetermination order has been sought. they can however, and I suspect thats what may happen, offer you a 'once in a lifetime reduced amount opportunity to pay off the whole things at 30% of the total' but they have no right to ask for the full amount, or anything more than the court has ordered you pay.

Just keep up your payments to Nemo and wait and see if anything appears from Link.

I have a devious mind, and maybe some people may stop paying Nemo because of the letter, in which case you will have breached the order and Nemo can get their way

Letter sounds okay to me - you make your payments to Nemo, until such time as you hear from Link. then make the same payment to them. They can't up it or change the terms to your detriment at all so i really wouldnt worry. If they try it we'll bash em

I would be inclined to ignore the letter from Nemo, wait and see if Link crawl out of the woodwork. They can't do anything without taking it back to court. Just keep paying what the court has ordered. If and when Link crawl out from under their stone you can cross that bridge if and when you get to it.
