Dougal - it is stated as a seperate entity in the contract and not included within the total charge for credit figure.

Hm... is that the entire policy document? is there a document with ultra small print.

Why are they claiming depression is NOT COVERED by the policy? It clearly is, as long as it is diagnosed by a professional, and you are obtaining a course of treatment for it. Had you been depressed within a year of the policy starting?

It may come under a prediagnosed condition depending on the previous occurance and the T&Cs on prediagnosed. not really sure how that works with depression.

No, they define "pre-existing medical condition" as one you know about when the cover starts (were you depressed at the time you got covered) OR which you've had within 12 months of taking out the cover. So, were you recieving treatment or had you gone to the doctor about depression in the 12 months preceeding the date the cover started?

Did you go to the doctor about this depression after it started again?

Were you and hubby on job seekers allowance, in which the PPI should kick in anyway?

Incidentally, can you look through your S.A.R. and see if there is a default notice from NEMO.

Yes there was a bout of depression within 12 months either side of the policy starting.

Did you go to the doctor about this depression after it started again? Yes, and I was on meds

Hubby was refused JSA as they deemed my wage too high! (I was a payroll clerk for my local council which is not well paid at all), he just took the first job that came along which was cleaning and considerably less well paid than the job he was doing when we took out the loan. Anther spanner that was thrown into the mix was my discovering I was pregnant. I ended up going onto maternity leave several weeks earlier than intended due to sympysis pubis dysfunction and depression.

Hm, so the bout of depression was something that was on the radar (i.e. you went to the doctor about?) That's a real pity, in which case you can't claim on it.

I would talk to Curlyben about whether the PPI was missold, anyway, I would not put it past NEMO.

I'll have a little think about things.

Is that the only default notice they sent you before terminating the account? Because it is utterly worthless.

I think so, if I recall correctly the primary lender began repo proceedings not long after this letter, we assumed that Nemo had been informed as we didn't hear anything from them for months. I am now going to take some time to get all the paper work together and sort it into some sort of order, shouldn't take me too long I hope.

My apologies for any confusion and thanks for the correction - I jumped before I checked it was safe to do so, as usual!!

The only excuse I can offer is 'I was trying to help'...and looking at the problem from another angle perhaps?

Best wishes in the good fight.
