    Hi me again, I've had no reply from the company themselves and have just received a claims form with extra charges court fees etc on there, what should I do? thanks in advance

      OK things to do.
      Acknowledge Service of Claim ( you can do it online (money claim online)
      State intention to defend.
      Is the claim in RWs name?#
      Is there a solicitor involved?#

      Post up the Particulars/Statement of claim here, after removing Claim No, and Barcodes and your personal details, name/address etc.

      This I'm afraid is par for the course with RW and its masters.
      Having tried to settle out of court will be a point in your favour.

            AOS first and state intention to defend, gives you more time to sort out your defence.
            Once that's done we can look at the points for your defence.
            Sorry internet dropped out.
            A CPR 31.14 request to Cohen for documents mentioned in the POC e.g. "the terms and conditions of the bank account". and the notice of assignment.
            As there is already an offer on the table I would recommend opting for mediation via HMCTS Small Claims Mediation Service you start with the advantage of already having made an offer to settle, the benefit of mediation is that if agreement is reached no CCJ is registered.

                I have submitted to defend all of the claim and an to contest the jurisdiction.

                    It's asking me to state my defence ? Surely I've not got one , we did owe the money , I think I've done this to late now , it's dated 31st March this would been done before I sent the letter, I'm assuming there done this after the call I made to them which they never responded to , they said they would call me bk an never so I called them again, that's when I found this site an wrote the letter

                        Your defence to this is that you have tried to negotiate a settlement with RW by making an F&F settlement, which has been ignored.
                        Tick the box as willing to partake of Mediation.
                        Get this in asap or you will get a Judgement by Default.
                        Mediation gives you the chance to settle without getting a CCJ.

                            On 2 occasions I called Robinson way to make an offer to settle
                            the account, the 1st call ended with them saying they would call
                            me back within 1 week, they never. I then called then back 1 week
                            1 day to be told my offer was declined and that the person dealing
                            with this was to busy to talk, I was told again that I would get a
                            call back, I never. I then sent a letter making the offer again, I
                            sent this recorded delivery to Ms Louise Schofield. The next I
                            herd was this claims form. I would prefer to get this sorted with
                            no ccj and my credit file cleared of this as I did make contact
                            with them, I believe they do record there calls so I'm sure they
                            could provide these to prove the conversation had. I will also
                            have my phone records. I would be willing to partake of Mediation
                            if this would be available.

                            Would this his be ok?

                              You need to layout the defence in numbered sections.
                              e.g.
                              Robinson Way - v - Your name Claim No. xxxxxxxxxxxxx

                              I xxxxxxxx am the defendant in this matter.

                              2. I am admitting liability for this debt.
                              3. An approach was made to Robison Way by telephone on date.................... making an offer of £xxx .xx in full and final payment of the debt.
                              3(a) Robison Way promised to telephone with in 7 days to give a response to my offer. Robinson Way telephoned me on date..... an declined my offer.
                              4. The claimant declined the offer and proceeded to issue this claim
                              5. On date.............. I sent a further letter addresses to Ms L Schofield of Robison Way repeating my offer of Full & Final Settlement.
                              6. No response has been received and the claimant then issued this claim.
                              7. I am willing to take part in mediation under the HMCTS Small Claim Mediation Service.

                              Statement of truth.
                              The statements above are true to the best of my knowledge and belief.

                              Signed: Dated.


                              Add the dates and your name where necessary.
