    HI guys


    I'm looking for some advice .....
    My boyfriend when he was young a stupid took out a overdraft of £900 - he never paid this back (2007-8) . It has now gone to Robinson way for the amount of £1123.35- they have been sending letters for a while now, we then recieved a letter from there solisters saying if we don't get in contact an pay it will go to a ccj!! I called Robinson way an offered them 400 as we just want to clear this now an they have declined , what should we do?? I'm new to this an don't understand the short text 😬

        Hi Welcome,

        Please never phone a debt collection agency to make a deal or discuss anything, phone calls are easily denied and manipulated.

        What we need to know.

        1. Is Robinson Way acting on behalf of Satan's Bank or has the debt been sold?
        2.When was the last payment/transaction/written acknowledgment made on the account?
        3. When did the bank first Demand Payment in full?
        4. Does this appear on his credit reference files? (important to find out the default date if not known).
        5. It is possible given the 2007/2008 time scale you mention that this is statute barred.

        Check Credit Reference Files ( Equifax and Experian/Credit Expert have 30 day free trials, Noddle is free online)

        Get the information and come back to this thread, do not phone e-mail or write to RW at this stage.
        Once the information is available it will be easier to advise.

              Thank u , I'll try to get as much info as poss , I won't have the letter or know the date of when Santander 1st ask for full payment - I'll check the letters we do have to see if the dept has been brought or not ( will it say in the letters? ) unfortunately he has not ever been organised :/ on the credit file it just got this for Santander ( I think I've attached an image)

                OK I can see that the account was closed 29/12/209 so the demand for payment would be prior to that date.
                I suggest checking Noddle Call Credit free online credit report to see what is registered.

                  Just checked the rest of credit file an it's showing on there as hoist with the total amount

                        Ok default placed in June 2009. Account Closed June 2009 guessing final demand/ call for payment in full May 2009.
                        So not statute barred.
                        Although the first " statement " shows end 29/12/2009???

                          I really don't know , what do u mean statement? I'm so rubbish at this stuff , also what is statute barred?
                          So by this should I assume that they have bought the debt? No contact was made to the bank and the last call to RW was this morning an they told me the offer was declined an that they would get someone to call me back to negiotiate ten I looked on here an realised I shouldn't of called

                            CRA print out.

                            Statute Barred under the provisions of the Limitation Act 1980.

                            If there has been no payment from or relevant contact with the debtor once years has elapsed court action cannot be taken.

                            Make the Offer ( if that is your preferred option) in writing to R W.
                            The offer should be addressed to Ms Louise Schofield, Director of Operations who remit includes legal affairs.

                            Mark it private and confidential.

                            The Offer should no start at the point you already reached £ 400.00. I seriously doubt the person you spoke to has any authority to make such a decision.

                            This offer is conditional upon the following:

                            1. Any remaining balance will not be sol or assigned for collection to any 3rd Party.
                            2. Credit Files are to be marked a " settled" and the default marker removed. ( possible but no guarantee)
                            3. If this offer is accepted payment as a gesture of good will and without acceptance of any liability will be
                            made within 7 days of receipt of written acceptance of the offer and the condition under which it is made.

                            Use signed for post, check receipt.

                              So as they have refused my offer already , what do u think I should do?can we get away with not paying this then? If so do I need to write?

                              whats a CRA print out?

                              Does this his mean they cannot get a ccj on him?
