It was an embarrased defence as I couldnot plea anything. I had no paperwork to refer back to.
I don, t know why cel left message saying hold on but not followed up.

I filed my embarrassed defense on 17th Jan;14 i think but got questionnaire in the post last Saturday. I have sent 2 msgs but not getting any reply from CEL.

any advice anything i can prepare in advance.

It would be best if you got in touch with her, her email address is on her signature. She may be busy and/or have received lots of emails/PMs, it's easy to lose track when you have a lot going on.

If you received a directions questionnaire, you have to fill it in and return it, usually within 28 days.

So sorry for the delay, its been chaos this end for various reasons.

Can you email me a copy of the defence you entered on the 17th January so that we can decide whether theres any point trying for an Unless Order.

As FP says, you have up to 28 days to return AQ, so it hasnt been allocated just yet.

You should have 28 days to return the questionnaire.

Do you mean:

A1 Do you agree to this case being referred to the Small Claims Mediation Service?

Unless you have a reason to object, you can just tick 'Yes'.

yes it is the one which says do you want to be referred to small mediation team. there was another letter from court saying i should return it by 17th Feb. I think i will email them with attachment.

hi,
I have asked for SAR from capital one on 24th Dec;13 with a £10 postal order and got receipt of postage confirmed by Royal Mail.
Capital one then asked me to provide them with signature /passport copy. I have done that sent them those requested documents
by confirmed Royal Mail postage.

I now got another letter today asking me to provide them with correct payment as I haven't done so. I have included a postal order for
£10 in my First Post. I don't understand what are they playing at.

Can anyone advice please.

I have received the SAR today from CapitalOne. It includes the statement, Ts&Cs with my initial agreement signed.

What shall I do now. Does that mean will I stand any chance at all now.

Hi,

I have already posted the questionnaire back last month 17th Feb;14. I had a phone call from mediation team but they said we cannot do anything as we cannot force BC / Lowell to provide you with documentation.

She said it will be passed onto your local court.

I have included the agreement form as CapitalOne has sent me. It has got few letter and statement dated back in 2008 and recorded my last payment date was 09 Apr;14.

Please let me know if these scan is readable or do I need to upload it again.
