      Remission 1: Full remission based on receipt of one of the benefits listed below.
      • Income Support
      • Income-based Jobseeker’s Allowance
      • Pension Credit guarantee credit
      • Income-related Employment and Support Allowance
      • Working Tax Credit but not also receiving Child Tax Credit
      The court will need to see evidence that you are in receipt of one of these benefits.


      If you don't receive those benefits then I believe you have to complete Section 4 as well - but if you do - then it says quite clearly - ''If you have ticked any of the above boxes - Go to section 6 ''

      Did you send the evidences ? ( You must provide correctly dated
      documentary evidence to show you
      receive one of these benefits. )

        i sent letter from benefits stating i was getting employment support allowance
        i stated that in my thread

                  Letter from court today

                  To all parties
                  This claim has been transferred to my local court for that court to deal with the defendants application for the claim to be struck out.
                  That court will send. You and other parties notice of the time and date and place of hearing.

                      What are you lloking for?

                      You just need to reiterate your position to the court that you have reasonably asked for documents that would be required before the Claimant would be entitled to have the debt enforced by the court, due to it being covered by the Consumer Credit Act 1974, and that they have failedd to show evidence of these documents so you have made the reasonable assumption they have no claim.

                        You also need to quote the 'Mitchell' case in court that has recently made clear no leeway is being given with regard to CPR compliance
