    Do you know where i should send the letter to? The address they have given me was PO Box 3424, Chester CH1 9BS - does this sound right??? Is this the right letter???? They are already denying verbally that they need to supply this info - so shoudl i send anythign else with the letter???

    We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a legible
    copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    We understand a copy of our credit agreement should be supplied within 12 working days.

    We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    Sorry that i'm panicing (it's something i do well!!) It was just very scary getting a phone call like that out of the blue. i know that from now on all is done in writing - no verbal communication!!!

    From what I understand they have 12 days to comply - What do I do after that (as i get a feeling i'm not going to hear a whisper from them!)

      Well the little devils!! It would appear the lady I spoke with gave me the wrong address!! The address all correspondance should go to is:

        Hold fire.
        The address you want to use is Thames Crudit, as they are the ones demanding payment now.

          Outspoken,

          During 2006 I was paying Thames Credit monthly for a 6.8k debt to the Halifax, and then I joined another site that will remain nameless. Anyway I sent them a CCA request and they couldn't supply it and I have in my possession a letter saying that they have written the debt off.
          I hope that this goes a little way to making you feel a bit better hun and stops you panicking.

            Curly - thank you very much indeed for the help and advice, it's very much valved and appreciated. I hadn't seen your post till this morning and i've already sent the letter (to the Chester Office), would it ok to ask a couple of questions please?

            Should I re send to address and send the version of the letter you have recommended?
            If so do i need to send another £1.00 payment???

              And the phone calls begin!! I've had 3 calls from them today. They asked me why I had sent a £1.00 cheque!! They were told to read the letter as I am disputing the debt. They then asked me why i had made previous payments to clear the debt if I did not believe the debt was mine.

              I repeated that they should read the letter and i await the required information. I would then write to them. Phone call was then ended by me!!

              Looks like the battle has begun.....

                  I sent the letter of the 23rd by Signed for Post, but according the post office it is still being processed. However the £1.00 cheque that was in the envelope showed on my bank account this morning as cleared, so I am assuming that this would show as evidence that they received the CCA request?

                  I have had numerous phone calls from them since they received the letter (about 3/4 a day). Once I know it is them phoning I have stated on each phone call that I do not intend to enter into any verbal communication with them and all correspondance must be in writing and end the call. They have until the 10th October to send the required info.

                  Is this right and is there anything else I should be doing???

                      Ok send them this letter, then after a few days these numpties (hopefully) won't call again and if they do, keep a record of times/dates of the calls and get ready to report them to the relevant people. But you'll actually find they won't call anyway.

                      I am writing to complain about the high number of telephone calls I have received from your company.
                      Despite a verbal request to stop these calls, I am still being contacted and I deem this to be personal harassment.
                      I now request that ALL further contact from your company be by letter only.

                      I believe that your continued harassment of me by telephone places you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

                      If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, which could result in a substantial fine against your company.

                      Be advised that any further telephone calls from your company will be recorded.

                          Just got home to a letter from them

                          It says:

                          We acknowledge receipt of your recent correspondance, the contents of which have been noted.

                          We have placed a request with the orginator and at such time as we are furnished with a copy of the orginial argeement, we will write to you again.

                          We thank you for your patience.

                          I guess this is the standard letter they send, so I now sit back and wait??????

                                i have received a letter from Thames re the phone calls, they state they have removed my number from their system and will only contact me in writing. they are sticking to this as i haven't heard a peep out of them so that's a bonus.

                                However the deadline for the CCA has passed and apart from a letter acknowledging receipt of the letter i've had diddly squat from them.

                                What do i do now? I am very concerned about this alledged debt as they are addign 1.5% interest per month and i want to get this sorted. i don't really want to leave it drifting - how can i get this matter concluded?
