    Well it's already in with FOS - and funny enough it's excatly the 14 days that they had to respond before FOS passed it over to a case worker......

    Do i need to send a copy to FOS and explain why I am dissatified with AK response and that I feel teh matter is not concluded to my satisfaction?

            Well inbetween me trying to come up with a response, FOS have responded to my complaint and told me to bog off. However they have got everything mixed up comletely

            They state in their response they refer to a cap 1 account - but the complaint is about an old barclays account. I have written to FOS about my cap 1 account too, but that is a completely seperate matter.

            Anyhow their reponse is that they don't get involved with unenforceable agreements - they fact that they have one is enough proof to demand and expect payment. They state it is a legal matter and only the courts can resolve that one, so they are not upholding may account.

            Is there any point in reponding to FOS - as even if i point out they are referring to a cap 1 account when the account in question is a barclaycard one, they are obviously not going to uphold the unenforceable agreement to my favour.

            Should I wait and see what AK do next. They will have to take me to court as hell will freeze over before i pay them another penny

              Have received the 2nd response back from FOS and its still a bog off and that unenforceable agreements are a court matter.

              So AK have crawled out from under their rock and have now sent me a letter letting me know FOS has rejected my claim and I need to start repaying them asap. They have invited me to conatct them with my proposal.

              Any ideas what i send them???

                  Court matter sounds familiar from FOS I have had the same type response to my HSBC complaint yesterday to them quoting the same wording it is now 2012.
