        Oh, I'm so sorry to everyone that's been posting on my thread. I hadn't received any e-mail telling me there were new posts, so I assumed there wasn't. Unbeknown to me, e-mails had gone into my spam folder. So, sincere apologies - I promise I wasn't ignoring you deliberately ;-)

        Have just recently sent another letter to Carp1, basically saying that due to discrepancies in the information they have provided, I do not accept nor believe they have a correctly executed agreement, and to 'go away'.

        No doubt I shall hear more from one or other of their DCA's soon.

          Back again.

          Cap1, in their latest letter, are quoting the judgement given by His Honour Judge Waksman QC in the Mercantile Court.

          Can anyone enlighten me as to the important parts of this judgement are? I've a feeling that it relates to being able to provide a reconsituted agreement, but I'm not totally sure. But is this also the Judge that made comment about people being responsible to their debtors, regardless of whether CCA's are drawn up correctly or not?

          Cap1 have also said that they are "making a complaint to the Solicitors Regulation Authority in respect of any further complaints that are subsequently sent to us that raise some or all of those issues".

          I'm lost - haven't a clue what they're talking about, or indeed how (if) to respond.

          Can anyone help please?

              As far as I can see, the judgement relates to Lenders being able to provide a reconstituted agreement under a S78/79 request.

              Could there be a valid reason why a lender might do this instead of just copying the original agreement? If the actual agreement is drawn up correctly, why wouldn't they just provide that?

              They still have to provide the original if they want to take me to Court, right?
