      Well the anger overcame me I'm afraid.
      I was certainly not happy with the FOS's reply, having read the booklet and they say you must attempt to resolve the matter yourself.
      I have written to Natwest scores of times, then Trident, then TDM all with the same info.
      Then starting January this year have written again upteen times to Moorcroft and again Natwest.
      So I really don't think that I haven't tried to resolve it myself at all.
      As for FOS needing a final response so they can act, I think 'Intended Litigation' from a DCA is final enough so thats what I have said.
      Right or wrong I have really had enough of this, when there is no need for it at all.
      I honestly feel Natwest have behaved wrongly and IMO needlessly as the 'so called' debt is being repaid through a DMP as they should know and even if they win they will get no more from the lad as he has no more to give.
      Rant over.

        A letter from Natwest yesterday acknowledging my complaint and once again logging it.
        They also mentioned the OFT thingy and sent me a hardship form to fill in.
        I have done a reply letter once again, for the umpteenth time explaining about this account.
        I also got the exact same letter from the same person this morning (they do have money to waste these institutions don't they?).
        So put a little ps on my letter telling her this was in reply to both letters from her sent on two different days.
        I also said I have complained to the FOS about how this account has been handled and I am leaving it in their hands.
        Can't wait for the next letter or even guess who it will be from lol

          Nelly, as well as reporting them to the FOS report them to the OFT

          Do you have a genuine complaint against a DCA or Collections Department?
          Are they acting against OFT Debt Collection Guidelines?

            I had a look at the complaint form, meaning to do that ages ago, I think the form was a bit confusing, but that's not hard for me is it?

            After writing back to FOS saying I think a DCA letter threatening with court action is as final reply as I am going to get from Natwest and asking them to consider my complaint. I have received a letter just the same as the very first one from them. It simply says they have received it and are busy.
            I really do not think any of these people read any of the letters they recieive at all, let alone briefly.
            I am totally disgusted in the Judicial, Financial and all the Services set up to help the consumer at the moment, so a good old moan will do me good. :tinysmile_cry_t:

                        Well a little progress on this I feel. A letter just arrived saying that my complaint has been read carefully and a full response or update will be sent within 10 working days.

                        Also included a booklet "Customer complaints - making things better" :tinysmile_cry_t:

                        Just remembered the old saying about making things better Natwest lol

                          I wouldn`t get your hopes up too much Nelly, the OFT vary rarely act on singular complaints unless they are extremely severe in nature.

                          The good side is that you can now use this to your advantage and inform Natwest that the OFT have received your complaint..............even give them the reference number for good measure . That may just kick their arses into gear and finally listen to your concerns, then again it may not, but at least it`s another part of the paper trail should it ever go to Court and something a Judge would look unfavourably on Natwest for their continued failures to assist.

                            It is a set template. The leaflet is standard and sent out in letter 1. I remember those leaflets which I had to send out. Usual FSA standard stuff.
                            Now let me think how the template was........
                            your address on the left hand side, office where the letter came from to the right. Complaint reference number underlined and in bold.
                            Dear Enaid,
                            Thank you for your letter [dated] and I am sorry to hear that you were unhappy etc,etc,
                            Body of complaint within letter
                            Reason why they can't resolve it straight away with follow up within 10 working days of date of letter,
                            If you need to contact me further please call with number given
                            yours sincerely(yeah right!)
                            NatWest.

                            Something like the above?

                                Ok letter from OFT, can't understand it TBH, so hope someone can explain it to me.


                                Unfortunately the letter enclosed is not the firm's final response letter.
                                ( I sent the threat of court letter from DCA and asked exactly what they considered to be a final response.)

                                they said
                                I should explain that a final decision letter would give referral rights to the FOS, within six months of the date of the letter.
                                Any idea what this is about cause I havent?

                                Then they say
                                If however you have not yet received this letter, you would need to respond directly to the firm's most recent correspondence in order for a final response to be issued.
                                Still clueless, what letter do they mean please?
