They are probably up all night preparing a blag blag letter.
They are tried to be a bit to clever with me. I asked for a break down of the charges and interest they have been applying to my account. They sent it rather swiftly for them. They also sent a statement of the disputed loan account, possibily to remind me.
Ha Ha Ha, it wasn't mine, some other customers, breach of the data protection act springs to mind
Little letter gone off to them reminding them of the legal duties regarding safe storage of customers data. They have 7 days
Don't ya love them
Will await their response and then off to the Ico

It's bloody frightening really though.
The way they come across all legal and scary lol and they make mistakes like that.
It's just a good job the wrong info came to someone like you, I am sure you will help them remedy the mistake and let them know in the nicest possible way of course, that this must not happen again lol

Yes when I noticed this little error by them it truely filled me with glee Especially when they are trying to be the big bully boys and they fall flat on their face.
They need to be a bit more careful with customers data. They cannot locate or provide me with any agreements, perhaps they have sent them to some-one else:cry:
Last year another grand company did the same, sent me another customers credit agreement. Well it was infact a application form, address, telephone no, bank details. Bet my response wiped the smile of their faces and more so when the ICO was informed and investigated.

Well am well and truly stumped now, have this morning received a paying in book from Moorcroft.
We would confirm that we are prepared to accept your offer to pay a minmum payment of £**.** per month to discharge the above debt.
Then the dates the payments must be made and a note about reviewing it periodically.
Don't know where the offer has come from, must be from CCCS cause that is who it is being paid to at the moment.
Had no reply from the CCA letter which is 12 days up on the 24th Jan.
What do I do now please?

Send back the paying in book and write a covering letter letting them know that you have no idea why have sent this to you and you can only conclude that it must have been sent to you by mistake.
Do not mention CCCS and do not offer any other information.
Let them do the work.

Letter received today thanking for the request for signed copy of the relevant agreement.
Postal order forwarded to their client, who confirmed that the relevant info will be provided as quickly as possible. Account is now on hold awaiting further instructions from their client.
See what happens now then I suppose.

Ok letter received form Natwest, thanking me for the letter requesting info re the CCA1974 and that I have asked for a copy of the signed agrrement.
Under section 78 of thE act, on receiPT of a written request, the bank is obliged to provide:
- A copy of a signed agreement (if any)
- Any other documents reffered to in the agreement
- A note of the state of the account (i.e. the balance, details of the interest and charges outstanding and the applicable interest rate) signed by a representative of the bank.
Then goes on to tell me about not having a signed agreement on O/D's which I already knew.
Now can someone please confirm, because I thought they had to put in any payments that had been made into the account also? or is this not so?
Also the letter was originally sent to the DCA, who passed it on to Natwest, hence this letter. In my letter I also asked they supply proof that the DCA could indeed collect this debt.
So once again I am totally confused as to his collecting this debt made up all of unlawful bank charges.
Will it be Natwest? the DCA? and when will any of them understand it is being paid monthly as part of a DMP?
Any suggestions? please
