    Ok have done an up to date spready with 8% interest added no - ' compensatory' - 8% etc sec 15 of waiver (15)
    to the extent that sums are ultimately to be paid to complainants in respect of relevant charges complaints that have been stayed, the firm must include in these sums anelement of compensation in respect of interest charged to or lost by the customer . the 8% added cause of this.

    Then if I add the interest added to this account as well.

    Then add the total paid through the DMP.

    I make it Natwest owe me £140.87 so I will write and tell them that.
    I may even make an offer lol

      Well after all that effort, what a waste of bloody time, CCCS are paying Moorcroft. I totally give up, I can't believe they can just do that tbh but they have.
      I hereby sling the towel in.

          I have just got the lad to ring and give permission for me to speak for him. The chap at CCCS has said that the debt had been defaulted and that's all that is needed for Natwest to sell off the debt they do not have to inform us that the debt has been passed on.
          So Moorcroft need no letter of Assignment or anything.
          Am in knots tbh and totally peed off.

            Generally speaking this statement is true, but there is still a procedure that Natwest must follow. Quite apart from the procedure (that they have not followed) this account is in dispute and is therefore contrary to the OFT guidelines on debt collection 2.8(k) - not ceasing collection activity whilst investigating a reasonably queried or disputed debt.

              Yes they do. You need to write to Natwest and demand that they recall this debt from Moorcroft and tell Moorcroft that you will not correspond with them again.
              I have written to Natwest I will PM you the letter


              Well according to the chap from CCCS they don't as the account has been defaulted they can sell it without telling us, the default letter states this he says.
              He said I can't just pay the debt off to who I prefer to pay it to, so now he said to RING Natwest and see who owns the debt.
              I said I RING no one it's all done by letter.
              All this regardless of the debt being in dispute or not, so you see even the DMP people don't know what's going on, so how are we to know?

                Ok sent another letter on 23rd Jan, informing Natwest once again and I think for the sixth time this debt is in dispute and has been for over 12 months. Also said would continue to pay through DMP, but not to Moorcroft as the debt should never have been passed on to them.
                Also sent an up to date schedule of charges.

                Thanks for you recent correspondence, your comments have been noted.
                A copy of your correspondence has been forwarded to the Customer relations Unit in Borehamwood, as they deal with registering claims. They should be in contact with you soon.
                Now I am wondering, do they think this is a new claim and are just registering it?
                Or may this be where they are actually sorting out the claims ready to cough up ?

                  It sounds like a generic letter they send out for any claims requests. A no brainer reply

                    Well thats' what I thought, they have just looked at the schedule of charges and presumed it was a new claim.
                    They have not read the letter I wrote then at all, it really makes me sick TBH.
                    I think I need to complain to the people I threatened to complain to in my last letter, maybe they can get Natwest to read. I will wait to see where the DMP money went first though this month. If it went to Moorcrofts I will go mad.

                      I know it is always best practice to have the debt returned to the original creditor, but, as long as your payments are going to towards the original debt that is something. I do agree you should send a complaint letter to Natwest though, regarding not even attempting to respond correctly to your letter. If the debt has already gone to default then I would also recommend complaining to the OFT using the complaint form I posted

                      Do you have a genuine complaint against a DCA or Collections Department?
                      Are they acting against OFT Debt Collection Guidelines?

                      They may not act on individual cases but the more complaints they receive the more likely they are to act against a particular DCA or collections department.

                        Ah well spoke to soon on this thing.
                        Moorcroft sent "Notice of Intended Litigation" today, must pay by the 25th or else.
                        So sent them an email, telling them to return the account to natwest pronto, will also write as well.
                        Wrote to natwest telling them to recall account pronto, again reminded them of the facts about this account being in dispute re charges.
                        I am now doing the complaints letters to who ever will listen, cause I am sick and tired of Natwest and their complete ignorance.

                          Complaint letter sent to FOS and a reply from them saying they received complaint.
                          Also a note saying how busy they are, but will dealt with as soon as they can.

                            If the FOS gave you a complaint reference number then drop Natwest a little note informing them that you now have a complaint registered with the FOS and "here is the reference number for you to update your records" usually does the trick

                              Little note from Moorcroft arrived today.
                              Account is currently on hold pending a response from our client to your recent query raised.
                              As soon as they receive their reply they will contact me with regards to the outcome.
