    Ok I am so so peed off with this now.
    Got a reply from FOS, a leaflet enclosed on 'How to Complain'.
    The letter states that I must first have given the' business concerned a chance to put things right'.
    That they have written to Natwest with details of the complaint and have asked them to deal with the matter. Giving them 8 weeks to do so.

    Also in post a letter from Moorcroft I am going to give you this word for word cause I really can't believe it.

    I write in response to your recent dispute in relation to the above account and can confirm we have been in contact with National Westminster Bank PLC who have advised us that they sent you a letter on the 13th February 2009 giving you an address to register your complaint against the charges as it has not been finally settled in the courts.

    I trust the above response has now resolved your dispute. I can also confirm I have placed your account on hold and request you make immediate contact with our call centre on the above telephone number to discuss a repayment proposal you can afford and maintain.

    If you are unhappy with the information provided please contact us by return (or in amy event prior to the above date).

    The above date is the date of the letter lol 23rd March 2009.

    Ok what do I do now ?

    This account is with CCCS and has been paid monthly on a DMP
    This account is for nearly a grand and is totally made up of bank charges and I am sick to the back teeth of telling all concerned that it has been in dispute and my complaint noted since January 2008
    As for FOS how many times can I tell Natwest they are not following the waiver guidlines with this account by passing it to a DCA
    Going to work now totally peed off and disgusted at all concerned.

      the firm must not close accounts or threaten closure of accounts of customers when it might reasonably appear that this is for the purpose (or with the intent) of penalising customers that have complained about unauthorised overdraft charges for having complained, or deterring future complaints from these customers or others. For the avoidance of doubt, the firm may close accounts or threaten to close accounts where there is good justification for doing so based on the circumstances of the particular case;"

      Potentially it is this one. Might be worth a letter to them stating that you are very happy to call Moorcroft on the conclusion of the OFT test case as the amount of charges equal or exceed the amount that is in dispute. Should Moorcroft still pursue this debt then you make further representations to the OFT about this matter.

          OFT point was on debt collection activity for a debt in dispute.

            Does your boy not qualify for hardship? He has lost his job, he is essentially behind in his rent so he ahs arrears (as he is not paying you) might be worth a shot to try and get some of the charges back and get him sorted and stop these letters.

                  aww your so kind, it is all charges Mocha so the lad stands to gain no money from it at all just the money he has been paying through CCCS thats all so it wouldn't be like a hardship claim to pay off his debts.

                        Letter of 'Intended Litigation' from Moorcroft just arrived demanding full payment by 2nd April.
                        So am not writing to them now, but should I write to the FOS and tell them that while they are giving Natwest 8 weeks to reply with a final response I am getting all this from Moorcroft?
                        Or do I write to the chap at Natwest who is dealing with this and has 8 weeks to do so because I have his name and address?

                        Which one will be best do you think or maybe should I do both?

                          Again, do nothing. If they sue you (which they won't) you counter sue for the charges.

                          Simple.
