    Well number one under my belt thought I had better start new thread for claim number 2. When I can get the flippin SAR info.................. theyre still playing games............... still not sent anything, I wouldnt care Ive even told them which statements I need, i.e. numbers, theyve still not complied. They have until the end of this week only before I file at court for non compliance. And I will, they should know me better by now. Lol Lol Lol.

    Will be doing claim when I can get the info for going back to about 1992 to 2001 only. But its just how to get the info Im still struggling with. By hook or by crook I will get there though. I will post on here as soon as something is happening. Fendy xxxxx

      Fendy, you need to order by dates not statement numbers. Dates will get you the info not statement number.

        Soz nattie I didnt make that clear did I. I have asked for statements between account inception and finish date up to 2001 (the period I have not already claimed for) but so far they are saying they dont have the info. They are ignoring my letter and when I ring, they say they dont hold info going back that far, so Ive sent a letter asking them to get signed letter from Data Controller stating they dont hold info going back that far, or I am filing at court for non compliance. I can but try. Just got to keep at them on this one till they cave in.

          Have they said how far they are prepared to go back?
          Also full sar ie customer notes will provide the charges information, not statements but FULL SUBJECT ACCESS REQUEST. Add something to the effect that you require all customer notes on your account.

            Okies Nattie. I had a letter from Leanne at Premier Banking Suite in Bradford basically saying she could not help (shes Maddies assistant) manager at Bradford, she basically said she would pass my request onto the correct department. End of story. She is saying in her letter they only are obliged to produce info dating back 6 years and no more. Im gonna try ringing her tomorrow and say Its not just the statements I need but a full copy of my file. But my file dates back to account inception in 1991 or 1992 I believe. Thats the b*gger of it. I cant remember exactly when i opened my account hence why I said from account inception to 2001 which is when my last claim started from.

            Im still banking with Natwest, and will continue to do so unless they close my account, but if they do, I will file for retaliatory action against them. I have 3 other parachute current accounts so Im ok if they do decide to close me down. Fendy xxxx

              Under the Data Protection Act she is wrong, a subject access request, and just to be clear, when you speak to her tell her you are not requesting bank statements but all your data that natwest hold on you, account notes, the full data. If she wants to go there on statements she is talking a load of rubbish, quote her the process manuals stuff on the feedback site and it is referenced and tell her, that you know from a natwest source that she is wrong about a subject access request, you know she is wrong with regards to statements, and she needs to check with her statements team at what is called a Retail Operations Unit, or commonly known as a CSC(Customer Service Centre). If she still talks crap post again I will correct it, and I have it on good authority that the timescale she has said is WRONG 100%.

                    Can I chase them for it still???

                      Yes you can chase them for it Veilside whether they have settled or not. and you can take them to court to make them comply................... although I would wait and see what your case throws up tomorrow at court. Judge might award you compo then for non compliance if you mention it at the hearing............ he certainly seems to be gunning for Cobbetts on your claim. Lol Lol Lol Pmsl mate. It will be a walk in the park for you. Because we all know Cobbetts aint turning up............. you will have the judge to yourself to persuade gently that they are time waster and procrastinators and you wanted wasted costs too.                         Geez, Im so flippin ticked off with Nutty West. Im sure they are deliberately trying to wind me up. I received letter today from Joyce Tudor. It goes.........

                        Dear Mrs Weather,

                        I write to you with regards to your enquiry regardng Subject Access request dated 5th June which we received in our offices 22nd June 2007. (yeah, like hell they did, numpties)

                        the bank charges a fee of £10 squid for processing such a request.

                        We would be grateful if you could forward a cheque made payable to Nutwest for the sum of £10 squid to the above mentioned address. Please provide us with a letter of authorisation from Mr. N Weather, for the reason that in order to release joint account information, we do require consent from the other individual named n the account (what, even though it is an either or sign for account) chuffing numpties.                         Well I already sent letter last week recorded telling em they never fully complied with my SAR back in January for which I paid ten squid for, cheque number XXXXXX cashed on 2nd FEB etc. etc. etc.

                        So in order to be seen to play ball nicely, and not whack nutwest round the b*llocks with the ball then I am sending yet another cheque for ten squid, even though I should flipping well not have to because they never fully complied with my original SAR request , aghghgghghgghggghghggh, gawd this is gonna drive me potty second time around, I can tell. NVM, Im being nice cos my jollies is a little over two weeks away and I dont intend to start anything prelim wise until I get back from jollies. So there.......... I can afford a deep breath, big smile, play nicely, and do as the good lady says. Send me ten squid and wait wait wait. Again. Phew, god job Im going away........... I reckon me blood pressure wouldnt stand much more of this claiming without a break in between. Lol Lol Lol xxxx

                            Ooooooh cant wait. My file must be 8 inches thick from all the complaint letters about charges I have sent to them over the years. Seriously. Ever time they answered my letters they just said, basically tough, you go overdrawn, we charge, end of, deal with it. Im so looking forward to being reunited with copies of all those complaints Ive sent in over the years.                               Okies ringing Joyce tudor today to tell her I dont have to pay again for SAR, I already paid in January and cheque was cashed for that and they never fully complied with full SAR info. She what she has to say to that. Have also sent off another cheque and letter (just to be arsey, and to not hold up the process in case they wanna argue about it), doubly covered I should say. But so far nobody has either confirmed or denied they can go back over 6 years except Leanne at Bradford (who is a dumbo anyway and doesnt know her bum from her head), so Im not relying on her say so one way or another. The fact remains they have still never fully complied with request for FULL SAR, so I am quite within my rights to keep pursuing this until they comply. I flippin will get this info one way or another, even if it takes me another 6 months I will blummin well get it. If I have to stroke the ego of an inside natwest bank worker to get it, I will, Lol Lol Lol PMSL................................
