    So how do I manage to set one up? All I am getting is a brick wall, is there anything I can state that'll pose as a convenient reminder? Or is it a matter of persuasion?

      Speak to the court enforcement team and if they seem to be singing the "Speak to the Bailiff" song and will not co-operate, escalate the matter to the Regional Enforcement Team, who have more clout and can over-rule the court enforcement team.

        Got a day off today so I am trying to get the ball rolling before Friday when they want me to pay. How do I find out what court I was fined at? Also, on the final notice I was given i looked up my bailiffs names on the certificated bailiff register and he wasn't there, is that something to worry about?

          Which county are you in, please? Once this is known, I can post up the email address for the HMCTS Regional Enforcement Team for your area. As long as you have a court reference, they can trace the court from there. It sounds like you have not received a Further Steps Notice before Marstons got involved. This notice is a legal requirement and enforcement cannot be undertaken unless the defendant is served with it.

              I had a feeling it might be Kent, Surrey or Sussex. The HMCTS Regional Enforcement Team for your area is based at Maidstone. Their email address is su-sfuenforcequery@hmcts.gsi.gov.uk

              On you email, in the subject box, put "For Attn. Senior Enforcement Manager". The person who will probably deal with it is the Service Delivery Manager, but the Senior Enforcement Manager is in charge of the team.

              After the salutation (Dear Sir), head the email as follows -

              Full Name
              Date of Birth
              Current Home Address (including postcode)
              Court Reference

              Then give details in chronological order.

              If you have not received a Further Steps Notice, you will need to explain this in your email. Also, if you have moved address since the fine was imposed, you will need to state the address you were living at when the fine was imposed.

              Explain your financial position to the Regional Enforcement Team and what amounts you can realistically afford to make and how often. This will pre-empt the bailiff from scuttling off to the court to seek authority to force entry by trying to claim you are avoiding paying the fine. A favourite tactic of Marstons is to make it as difficult as possible for a debtor to pay a fine and then claim they are avoiding paying the fine. Another bailiff company contracted to HMCTS tried this tactic, got caught out by their own lies and had the distress warrant recalled by the Regional Enforcement Team for the area the debtor was in.

              Having helped LB members in the past liaise with HMCTS Regional Enforcement Teams, in my experience, the Regional Enforcement Teams tend, on the whole, to be very helpful.

                  I spoke to them, they emailed me back pretty quickly. They say a final steps notice was sent, although I do not remember ever seeing one. They also told me that I need to talk to the bailiffs about anything else. Where does this leave me? Obviously the bailiffs are not being very cooperative

                    I've heard this about the Kent/Surrey/Sussex Regional Enforcement Team. Did they give you the name of the court that issued the DW and the date the FSN was allegedly sent to you?

                      They didn't. They told just me that they had sent one and that the bailiffs needed talking to if I have any further enquiries. What is going to happen on Friday if I don't get an arrangement sorted, are they going to come round and take my things? My partner is pregnant and I have a 2 year old at home so she really doesn't need the stress if a bailiff comes to the door! I've let them down by letting things get the way they have anyway so hopefully I can get it sorted before it goes any further.

                        Get back onto them first thing tomorrow morning and ask for the necessary information. If they don't or won't co-operate, then escalate to the Head of Enforcement Operations (South) who is more senior to the Regional Enforcement Team. Their email address is southsupportunit@hmcts.gsi.gov.uk Mention in the email any non co-operation on the part of the Regional Enforcement Team.

                            In my experience, the majority of HMCTS Regional Enforcement Teams are very helpful. The Kent/Surrey/Sussex Regional Enforcement Team seem to making being as awkward as possible into an art form. The two Heads of Enforcement Operations are more senior and in a position to over-rule both court and regional enforcement teams.

                              Got a response back, the Final Steps Notice was sent on 16.01.13 and the warrant was issued by the kss enforcement office and not by the court. I don't know what that is!

                                KSS is either Kent, Surrey and Sussex, or Keep Seeming Stupid.

                                It may be difficult to determine any difference.
