Problem is the bailiff will not budge, he wants his beer tokends NOW and will be very happy if Op goes to Wonga or a loan shark merely to pay him. There is merit in pursuing through the admin route and using precedent to challenge if it highlights the absurdity in loading more debt on someone who cannot pasy the original. may well undermine as a side effect the whole Fixed Penalty system police not LA parking but if the principle is sound maybe they and the likes of JBW are in trouble.

If it is making it difficult for you to pay the fine, then, yes. It is a known tactic of Marstons to make it as difficult as possible for debtors to pay the fine and then claim the debtor is avoiding paying the fine. Strictly speaking, HMCTS Enforcement could recall a DW if it was shown this was going on. To be honest, HMCTS Enforcement are in charge of the enforcement process at all times, even though the impression one gets is that the likes of Marstons, Collectica, etc., are in charge. They are not. Area Enforcement Teams (aka Court Enforcement Teams) have the authority to recall DWs, if necessary, and to call the debtor to a court for a Means Hearing, or to swear a Statutory Declaration or to a Variation Hearing, where necessary. My dealings with Area and Regional HMCTS Enforcement Teams, on behalf of LB members, has shown that HMCTS staff are getting fed up with having to deal with the unacceptable conduct of contracted bailiffs, particularly, Marstons, the usual response being a sigh followed by "Oh. He may even 'phone someone for permission to use a "locksmith" or to kick your door down but, as far as I am aware, the courts are not open over the weekend.

Some Marston bailiffs seem to be under the delusion that Marston's management can authorise forced entry. Firstly, in their dreams and, secondly, not according to HMCTS Enforcement.Life is a journey on which we all travel, sometimes together, but never alone.

My partner is home alone for the vast majority of the day 5-6 days a week and I just couldn't have someone trying to knock the door down and intimidating her. I had to take out a payday loan in order to pay it off as I could only afford the £200. It was in no way shape or form what I wanted to happen but I didn't want to put her in a bad position. I don't think there is anything I can do about it now I've paid except try and ensure it never happens again. You have all been a huge help, I wish the HMCTS responded as quickly and as helpfully as you all have.
