He's either given you false particulars, which is highly irregular, if not, unlawful, despite what Marstons claim to the contrary, or he is not certificated, in which case, it could bring the manner in which the enforcement was carried out into question. Press Marstons for the name of the court that issued his certificate and the issue date. If they refuse and, in any case, I would complain to HMCTS Head of Enforcement Operations (South).

      EEEEEEEEK!!!!!!! NO! NO! NO!

If the bailiff does not appear on the register, contact Northampton County Court Bulk Centre on 0845 4085302 between 10.00am and 4 pm or via email (cbregister@hmcts.gsi.gov. uk) on a 5 day turn around. As the Register is not always up to date then even they may not know.

If the Bailiff or his company have divulged the Court the Certificate was granted at then contact that Court and ensure that you specifically ask that the Certificate was in use on the particular date that you are checking on. If the bailiff does not appear, you should inform the bailiff, ask to see a copy of his certificate, and ask in which court he was certificated, and when.

There have been cases, in the past, where it has been found that bailiffs have tendered false particulars to debtors in order to avoid being held to account. Someone did divulge to me that the practice does go on within the civil enforcement industry. I have also heard that the practice is indulged in to "protect" bailiffs. Oh yeah, what from? Being caught doing things they shouldn't be doing?

However, follow Labman's advice, in the first instance. If that draws a blank, then, there is a likelihood false particulars have been tendered by the bailiff.
