  • Paid PCN, repeat notices, multiple refs, no breakdown and harassment

Sorry if this is a bit long!

Briefly, PCN is on a car I no longer own. Bailiff company claim its from Nov 2012.
Bailiff clamped my car, on my drive, early in morning, didn't knock door, on which the PCN does not relate, and on calling bailiff, requested I pay nearly £600. Bailiff advises at the time there are another 4 PCN but are not enforceable yet.
    Clamp fell off, (wasn’t me!)
On making a payment through their online facility the fees went up to £1330.30 inc £1.20 debit card fee.
I paid £215.44 (+ £1.20) which was on their original letter.

Since then the bailiff has hounded me at a place he thought I was working at, car was in locked gated car park of a care home. He’d obviously been looking for it as he’d said the other 4 PCN’s were in same street (near my place of work) He caused a nuisance, claiming to be a ‘senior manager for the council’ and he was there to collect a car which had been reported ‘stolen’. He was not permitted access, I call police. Complaint has been put in to TEC, copying in bailiff company, with resolution to agree PCN paid and to advise bailiff to stop harassing me.

I then received a hand written enforcement notice with the original PCN bailiff clamped me for, and I have paid, plus another 4 PCN's, totally £1127.42 I have gone through all my paperwork, and I have not received one single letter from the company regarding the other 4 PCN's.
Notice only provides one PCN number the rest states 5 bailiff company refs. Have matched them with the help of the parking dept of council.
Bailiff company’s online pay facility states I should pay £1342.86 for every single one of them!
I write to TEC copying in bailiff company requesting further information and for fines to be returned to council for administration.
I then receive another Notice of Attendance, listing previously paid PCN and ref number, and now gives the balance “before todays visit” is £1342.86 (jumped from £1127.42) and now gives a total of £1859.01

I have now requested a breakdown from bailiff company, using template/example provided in sticky
Letters were only sent this week.
Is there anything else I can do?

(Just to confuse things even more, I have discovered a non certificated bailiff from another company, who entered my home using a locksmith, for which I have submitted a formal complaint with the police, is now certificated with this current company – can’t help feeling there’s a personal vendetta occurring!)

Which bailiffs are these? as in both companies?

This sounds like fraud on the part of the bailiff and the bailiff company. The one who claimed he was a "manager from the council" and had "come to collect a stolen car" is very lucky the police did not arrest him for Attempted Fraud by False Misrepresentation. I am wondering if you should report this to the District Judge at the court that issued this bailiff's certificate. Courts can revoke a bailiff's certificate without a Form 4 complaint and without a hearing, thanks to provisions within the Civil Procedures Rules, and have done so during 2012.

Half right - marstons (other posting) and JBW.
I've sent 2 formal complaints to TEC - one about the clamping, no paperwork, his conduct, the other about the hugely inflated fees - lets see what comes back
Have also requested fee breakdown from JBW. Will go online later and see if they still each come up with £1342.86 again!

Ok, just checked, "We are unable to accept your payment at this time as your account is currently allocated to a bailiff. Please contact Mr xxxxxxon N/A." on each.
Case has been passed to 4 bailiffs since 28.06.13 - only one of them has issued any paperwork with their name on it! The one listed I should contact - certificate expires 02.08.13, suppose he might have applied for a renewal and its not up as yet.

It would certainly be interesting to learn how anyone could justify such egregious overcharging.

When I called the non emergency line they had initially claimed it was a 'civil matter' as they heard the word 'bailiff' It was only when I pressed the issue that he was causing a nuisance at a care home, as reported by the staff, and at an establishment at which I was not present, did they agree to send some officers to attend. Weren't interested that he tried to con himself into a vulnerable adults home! Bailiff b*****ed off when I confirmed police were on their way.

Marstons bailiff - uncertificated as he had 6 months grace to obtain one (April 2013) was then certificated, public notice date 03.06.13, now registered with jbw 14.06.13.
jbw arrived out of the blue with a pcn addressed at an old address, and clamped car - no paperwork.

Didnt want a scene at the care home. It was embarrassing enough being called from the staff there saying this 'great big guy wants your car'.
Need to be a bit guarded what I say here (Im sure mr bailiffs scour these forums looking for info) but bottom line could have jeopardised my job if it at the time, it went further.

                        Fizz,

Is this thread linked to this one:

                        http://www.legalbeagles.info/forums/...311#post359311

or is it a totally separate bailiff issue you're dealing with at the same time as the one linked above?

Yes, sorry, confused it a bit, but they are actually two separate incidents.
This thread 'paid pcn' relates to jbw

Should have reported as "Bogus Official" especially as most police forces react to this much more positively, where vulnerable people are concerned as they will regard the bailiff on approach as being akin to a rip off builder after dodgy roof repairs, As both these scumbags were bogus, as far as the unfortunate recipients of their call were concerned, that would be the case.

I'm not surprised. He would have had some explaining to do. Stolen cars are, normally, collected by the police and taken to a secure pound for forensic examination and collection by the lawful owner, whether that be an insurance company or you or me.
