Re: Rossendale bailiffs &council tax HELP

The "inventory" is printed on the back of the back of the paper dated the 29th may and as you state completely blank. It will be interesting to see the reaction on Monday morning . I do fully intend to contact the council tax office on Monday morning as Bluebottle advises #2 . I hope I can do this before this woman attends with her "partner"! I also fully intend to speak to the director of finance for my town and make a formal complaint about their threats and illegal fees.
their are vaunerable people living in surrounding towns that will be scared witless over these people and simply pay ! It disgusts me that my own nan had to deal with these people before she died and here they are with their false claims and bully tactics still being allowed to speak to people and treat them in this manner simply because they had a tough time financially and was unable to pay their debt in full.... Which brings me to why they think if I didn't have enough to pay £177.00 with six kids and a part time job that doesn't cover my rent how do they think I am going to whip out £200 in fees because as she said and I quote " you need to pay for the van ,because that's what we drive !"
she should of got a taxi it would have been cheaper !!

There are rules governing levying and seizure of goods and their removal which bailiffs hope you don't know and frequently ignore. No valid and lawful levy, no justification for a van, no justification for van fee. It is fraud per se, end of story.

Remember you don't have to let her in, Film her through the letterbox to capture any threats and self incrimination you can use against her.

Re: Rossendale bailiffs &council tax HELP

District Judges are quite receptive to receiving video footage of certificated bailiffs behaving like morons. That happened last year with a Ross & Roberts bailiff. The result was that their certificate was revoked on the strength of that, witness statements and a police report with no Form 4 complaint having to be submitted or a hearing taking place. Although Civil Procedures Rules can be a bind with having to comply with them, in cases of certificated bailiffs behaving like morons, they can be a godsend, especially the provisions that allow a court to make a decision on its own initiative and dispense with a case without a hearing, which is what appears to have happened in the case of the R & R bailiff last year.

Bear this in mind because video footage can often speak volumes and be more damning than a written statement.

I will video all interactions with bailiffs and the council tomorrow. I can't film through the letterbox
though as it has brush things in it to prevent drafts :/ would it be advisable to open the door with the chain on ? Failing that I would have to film through spy hole ???

Door chain should be OK as it proves intention to exclude bailiff breaks the chain, it would be classed as unlawful forced entry, if plod turned up and the chain was on with the bailiffs foot in the door, it would be the bailiff breaching the peace.

It would be safer to open a window upstairs and video the jerk from there.

When you've finished, remember to close and lock the window.

I'd go for the 'filming out of top window'.....and maybe place a voice recording device near front door for when the inevitable foot v door scenario
