Are the court equally or more culpable also then for passing it to Marstons once it had been paid?

I think It depends and combine the facts that We cant get through to the court, and that Marsons fiddle about with dates, I can only go on the fact that I paid 16th January Marston's contacted me 28th January.

If any one in that company had a brain cell between them they would be classed as dangerous - the more I see the Marston name on this site now & the upset they are causing genuine people day in day out is really starting to annoy hell out of me & make my blood boil - why are they being allowed to continue operating like this???

I consider marstons a renegade out of control loose cannon that needs to be wound up, along with the whole of the Capita empire. They are lucky they are not operating in the USA where people can have guns...

Ok hubby spoke to Gareth Hughes who said he wanted to sort this out. Sent him details through email, reference umber, sequence of events etc.... Heard nothing! Time to take the matter further i think.

Give them it Qpips - if I was you think I'd be taking it up with a solicitor & remember what I said in my pm 2 u as well especially regarding the effects it's had on ur health & the time u've had 2 take off work bcos of it, according 2 BB Gareth Hughes got a bit judgemental regarding myself - what ever I did was in the past & when I was bad with the drink & I've changed my life around since then & keep my head down & stay out of trouble with the law - He's a fine one 2 talk considering the thugs, louts & bullies he employs 2 harass, intimidate & in general make people's lives a misery - think it's about time a government organisation stepped in & removed Marston's contract altogether for the way these brain dead monkeys are behaving & going on!!!

As such, Gareth Hughes should restrict any comments to the actions of the bailiff involved in your case. The comments he made about the court case are a matter for the courts, not Marstons. I have heard back from HMCTS East Midlands Enforcement Team and will be contacting them in the next few days.

Could I just add a small point.

The Contracts that HMCTS have with the 4 enforcement companies does indeed state that bailiffs enforcing distress warrants must be certificated. However, since the contract was issued there have been a number of amendments.

One such amendement is that bailiffs may work "uncertificated" ( enforcing such warrants) for a period of up to 6 months only. After this time, the bailiff must be certificated.

That moves the goalposts somewhat, as that will allow all manner of unsuitable people to be employed for the six months.
