Marston harrassment for court fine already paid!!

    Ok, have found out two interesting pieces of information! The 2 bailiffs who have visited me were not registered Bailiffs when they did so! Not sure what to do now but I am sure someone will!

      How did you reach that conclusion?

      I am not doubting your sincerity but, as this is so serious, one really has to check, double check and triple check that the data are factually correct.

        I phoned Liverpool County Court (Where Mr Hughes said they were certified) as they did not show on the register.

            Okay, I have managed to contact the court. There are discrepancies in what they tell me and what marstons tell me, including certification of bailiffs. I have emailed CEO of marstons to advise this! And asked him to provide copies of bailiff certificates, as it seems neither bailiff was certified when they tried to extort money from me ( and succeeded in the last case). Mr Hughes explaination was also contradictory not only to marstons reply, but to the courts response and even during the context of the reply! He has not responded. I have no choice but to go to my M.P and the media about this!

              Despite your apparent (and wholly understandable) floccinaucinihilipilification of Mr Hughes's comprehension of veracity, it is hardly astounding that there were discrepancies in his comments. Mr Hughes is only the CEO of the Marstongruppe and hence is neither omniscient nor is he expected to be. He relies on reports from his minions which, on this occasion, seem rather to have been less than entirely accurate.

                I would be surprised if the minions didn't try to hide the full remit of their shenanigans from Mr Hughes, to protect their backsides from a boot.

                  I have carefully read back on all of the posts to try to understand the complaint and it would "seem" that the court may well be at fault here.

                  You say that a fine was imposed on 3rd August for £560 and that on 22nd Sept you agreed to pay the fine at £50 per month. Was this "agreement" made by speaking with the Fines Officer and if so, did the Fines Officer advise you of the precise date each month that payments were to be made?

                  Also, if an agreement was accepted by the Court on 22nd September did the court not insist that a payment be made on that date to cover September?

                  You paid £50 on 17th October

                  You paid a further payment of £50 on 17th November

                  With regard to the payment "due" on 17th December did you call the court to explain that you would have difficulty in paying and if so, what was their response?

                  There is a legal requirement when an account defaults to provide a Further Steps Notice. This notice provides that if payment is not made within 10 days that a Distress Warrant would be issued. Have the court confirmed to you the DATE that a Further Steps Notice was sent?

                            There are some very interesting points raised here by Milo. It would appear that HM Courts have made a significant error in their dealings with you which clearly need addressing. I note you have pm'd her - are there further developments with this case?

                            Just for information, we try to keep all information on open forum here on LB so that other posters can benefit from the information being shared. Only in extremely sensitive cases should advice ever be sought, or given by private message in order to protect both the OP and the person advising. This is usually done after the intervention of site admin which has not happened in this case.

                            Any developments or updates would be welcomed, as it is concerning if HM Courts are behaving in this manner. I look forward to reading what has happened. Given the situation and my involvement with bailiffs and bailiff companies, I am quite sure things will have progressed by now. :beagle:

                                Another point that should be looked at is whether the court actually have the correct address on their system for you !!

                                This is vitally important as it may well explain the reason why you had not received either the Further Steps Notice or the initial letter from Marston Group.
