    Funny how now they care about data protection after their agent dealt with, took money from, and accepted my signature, even though it wasn't my fine!!

        Can anyone help with an email address from the courts as I am still having problems getting through, and I am back to work tomorrow after being off work with the stress of this!

              im a new user and dont yet really know how to post on these forums but need some help with a situation i am currently going through and would be appreciative if someone can either direct me how to start a new thread or help me on this one.

              I have an old court fine from manchester magistrates at my old address which went into default from a detachment of earnings because of a split in unemployment benefits while im at college.

              the original fine was for £125 and was quite happily paying itself off at a weekly rate. when it defaulted i was requested to pay the full ammount. when i was not contacted after a few weeks with a payment plan.... marsdens got in touch around xmas. i payed (to get em out my hair over the festive period £85 pounds) from the sum of 386 they rate i owed em.

              anyway i have since been phoned twice saying a bailiff has a distress warrant and wants to bring a lock smith n police etc. im just wondering whether this is legit as they say i now owe 490. Im at college 3 days and dont like the idea of some character turning up and puttin my mrs on the spot with 2 kids at home whilst im away.

              again if someone could direct me how to repost this as a new forum or if someone can help me out here..... apologies for the forum faux pas as im not a forum poster really

                The most they can charge in fees is £300 tops. If necessary, I can provide you with the telephone number of the Senior Enforcement Manager for the Manchester area in order that you can chase this up with them. Marstons must also prove to the the court that you are intentionally and persistently avoiding paying a fine before the court will authorise forced entry.

                Could you answer these questions, please -

                1. Have Marstons sent you a letter?
                2. Has any Marstons bailiff physically attended your home?
                3. How much of the fine is currently outstanding?

                        It may be easier to go through the HMCTS Senior Enforcement Manager (SEM) for the court that imposed the fine. For the Liverpool area, try these -

                        Senior Enforcement Manager (Cheshire and Merseyside)

                        Telephone: 01633 645112
                        Email: CH-CPOSupervisors@HMCTS.GSI.GOV.UK

                        Make sure you have the relevant court reference available when you ring. This should be on the Further Steps Notice or Marstons receipt. If the bailiff has lied and/or resorted to unlawful behaviour, he may be kissing his bailiff certificate goodbye or, possibly, be liable to prosecution. It will, however, depend on just how serious the bailiff's actions have been.

                          OMG i am fuming!! Liars!!! sent this to them:

                          Dear Sir

                          With reference to the above account, and prior to a formalcomplaint, can you please provide me with a breakdown of the charges.

                          This includes:
                          a - the time & date of any Bailiff action that incurreda Fee.
                          b - the reason for the fee.
                          c - the name(s) of the Bailiff(s) that attended on eachoccasion a Fee was charged.
                          d - the name(s) of the Court(s) the Bailiff(s) was/werecertificated at.
                          e - the date of the Certification.

                          Please also supply me with the dates that a Further StepsNotice and the original Distress Warrant was issued by the court.

                          This is not a Subject access request under the DataProtection Act S7 1998 so does not incur a fee of £10. You are obliged toprovide this information.


                          Please also provide acertified copy of the actual Distress Warrant as issued to you by the court anda certified copy of the Clamping Order Mr Cox should have provided in order tolegitimately clamp our car.".

                          I require this information within 14 days. Please be advisedthat copies of all correspondence will be also backed up by a copy in the postand sent to the court."

                          After some Bulls**t about Data protection I received this:

                          Dear *****

                          Thank you for your recent correspondence. Please be advised Mr Cox was certified at Liverpool County Court on 13 March 2013 and has an expiry of 12 March 2015.
                          (what about Mr Munro?) Please find a generated copy of the warrant (another copy of the Micky mouse microsoft warrant on Marstons headed paper)
                          In regard to the fees you incurred. These charges have been calculated in accordance with the magistrates court act 1980, and on a scale agreed with the ministry of Justice (MoJ). The breakdown is as follows;-

                          Fine £460

                          Compliance Fee 07/01/2013 £85 we had No notice of this!!!

                          Attendance to remove fee
                          03/04/2013 £215

                          Total £760

                          Payment forwarded from our client 08/02/13 £460 (I paid on 17/01/13)- in any case already paid prior to attendance fee!

                          Payment received £300

                          We can confirm that our records show that this case has now been paid in full. As such we will be taking no further action in respect of this matter
                          - CHEEK!! I WILL!!!
