    Do you think if i went to police HQ,asked to see the chief and explained whats happened .

    OR could that be a visit to the cells?

      Take legal advice, the plod may get a bit shirty with a direct approach, as the person on the desk may even be civillian, so will not know how to progress your inquiry.

        Well, that's disappointing Sleepyhead. I'm so sorry. But it does look as if it's worth going to the other one re the behaviour of the police.

        Did you get a chance to ask him about the wording of your appeal letter?

          The specialist solicitor is the one who can help you. This case needs to cover the actions of the CCTV operator and the police. Find out who operates the CCTV cameras that picked you up rolling a ciggie.

            I believe that pursuing a case of wrongful arrest and/or false imprisonment could be more effective (and lucrative!) than merely disputing the parking ticket.

              Agree CleverClogs, it would be, but as long as the copper can claim "reasonable suspicion" and rely on the CCTV to back it, the brief must discredit the CCTV operators evidence, and cast doubt on the overall mindset, as in someone is rolling a fag, oh it's a rollup, so it must be ganja. The parking ticket is secondary here, the real issue is the arrest, imprisonment, and release without charge, as there was never any real evidence beyond a rolled up fag and some baccy.

                Even the most rudimentary search would have established that no exotic smoking materials were involved.

                  I think the situation escalated because da Man had decided there was some 'erb and would go out of his way despite the lack of evidence to find some. I'm surprised they didn't strip out the car to check for some ganja, how determined plod was in this case, rather than park it up.

                      It should have been blindingly obvious that it wasn't ganja, which has a distinctive smell. It sounds to me that PC Plod got miffed because the CCTV operator had sent him on a wild goose chase.

                        There is no mistaking that smell, perhaps he felt obliged to arrest as they are trying to justify the CCTV, and Sleepyhead said the wrong thing at the wrong time, either way he needs to take advice on his next move

                          Hi,
                          Action against officer is an option,but right now its the PNC.

                          Its now become a matter of following proceedure correctly,due to my lack of knowledge about such things i am now the bad guy.
                          Though i am right in princeable,the fact i have filled my form in wrong makes meresponsible for my appeal being dismissed.
                          Going over my papers the TE9 form,i have ticked wrong box.
                          I ticked the box "i made representation" (i was referring to e-mail i sent them)
                          But should have ticked"i did not recieve Notice to owner/pcn because i was no longer living at this address it was sent to.This should be my appeal reason.

                          So in order for me to try and get another hearing,(following proceedure).
                          I now need to write to judge who dismissed my case and ask him if i can appeal,reason,NEW EVIDENCE,arrrrrrrrrrrrg,excuse outburst this is all drivin me crazy.

                          So now i am going to see this solicitor 30+ miles away this afternoon.will keep you updated.going for a kip.

                            Did not like him moment i saw him,when shook his sweaty hand i knew he would be a greedy man.Me ma told me to never trust enyone with fishy fingers.
                            No legal aid,no probono,no advice.Wasted my time.

                            I better hurry and write to judge.
                            Have new evidence from social.
                            The address they sent NTO,this is address on driving licence i used to hire car,so address they send correspondence to.According to social i was no fixed abode at this time (homeless).

                            The judge is only concerned as to the reasons why i did not fill the out of time witness statement in time,he is not concerned about circumstances of original ticket.So i may be guilty of filling in forms wrong,still doesnt make me guilty of original offence.

                            So when i write to judge will include new evidence but i will also explain to him/her that by dismissing my app to appeal they are denying my human right to due-process and fair judjment on offence that is proven i have not commited.What you think?
                            Am i digging a bigger hole with loads of costs.lol.
                            Not sure if i am right about due-process though.

                            Grasping at straws,could some one take a look at DPA (principle 6} action will cause distress.

                              Beintg NFA and backed as such with proof from DWP would or should indicate that there was no way of complting with deadlines, you could never get the relevant notices to respond to,

                                When i lived in Sally Army i was visited by lady from houseing to asses my housing needs.Interview over she left.
                                I was going to see my children and saw the lady at busstop offered her lift as was going in that direction.Next day got phone call with offer of a beautiful bungalow,gardens the place is heaven.
