No one will kick you, I promise you that and if they did I'll kick their backsides so hard they won't be able to type for a week. Please, please though do the N244 and get it sent in, your getting excellent advice here and I plead with you to follow it, once its done then pop into the area I've given you a link to and avail yourself of everything in there, start a thread and we will pop our heads in and support you.

Doing my own thing is following advice given to me by people who know better than me. Equally i want to get this stamped out as well so large organisations like Mind can use the info even though they can't do much else. It makes me feel better. I don;t know about a N244 if it helps I will do it. But please don't be critical as I am doing something and not hiding, support me don't kick me.

The N244 sounds more daunting than it actually is. Having done quite a few of these now for various people the format I have does seem to work. Will be back later as I don't have it here.

Yes, I can fully understand that. Emotional stress is very draining, but the HCEO issue will be taking its emotional stress out as well, and that is something it is within your hands to do something about very quickly. It also helps with one of the issues surrounding the shop, as you really don't need these characters around again.

The link is above, all you need to do is read the guidance, read Ploddertom's post again, complete it and send it off. You've achieved something really worthwhile and positive then. I have no doubt you can do it. :beagle:

Let PT come back to you with the info, in the meantime if you need to vent and rant out your frustrations, then we are all here for you.

If you want to, put it all in to a PM and send it to me, if you dont want me to read it, title it please delete and I will. Sometimes it helps to get the way you feel out of your head, if that makes sense at all.

Please don't ever worry about needing someone to talk to, its a normal human need, especially at a rough time, and we all understand that you just want this whole sorry episode over with, right now you can't see it but there is a light at the end of the tunnel. Soon enough you will see it and will be standing in it saying to the world "I did it!"

    Patchie,

Did you file the N244 as advised? If not, you need to do it. :beagle:

PLEASE listen to the advice given, and life will be MUCH easier for you. Going off doing your own thing may keep you busy, but it won't solve your problem and is likely to exacerbate your mental health.

File the N244 then do your best to forget about it - believe you me, I know how hard this can be, but try. Once you hear back, post up again. It would be good if you can post up to say the N244 is all sorted as well.

PLEASE don't ever feel alone, you have friends here, and they are good good people!

The CCTV evidence is a fantastic idea, and the breakdown of fees, again great idea!

There is always hope, its just atm, its hiding very well. No-one can be strong 24 hours a day 7 days a week, and sometimes we all need to shout out and have a shoulder to cry on, its not a bad thing, its a BRAVE thing to do. You are doing great, your standing up to the bullies and saying to the world I will NOT give in to this, only this time.. you have us Yobbos with you

    Re: A joke

Had a letter back from the people I owe money to. They will not take the debt back, though they would accept monies direct to cover the debt and their basic costs though whatever HCC consider their fair fees (another joke) though i find they were given the job by another collection (Hilton Baird)agency. The plaintiff received £380 from the £1000 they got from me the first time. They have protested to their people but surprise surprise they are denying it. I have sent letters to the Northampton Bulk Court Manager and to other bodies including Mind and CAB. I am trying to see if I can get video footage as I have realised that all this took place under the Council camera in the car park but I don't think that will work.

I thought I was doing OK but this with other things has really brought me down very hard. It is me against the world again and I am not sure if I can stand it.

I have written to HCC to get a breakdown of fees. I just don't know what else to do.

    Re: A joke

Thank you for your previous replies I have a bit of a clearer picture in my mind of the process that has happened over this. You asked about Trade Bodies that HCC may be involved with - if they are memebers it will be the High Court Enforcement Officers Association http://www.hceoa.org.uk/ , unlike other enforcement agencies trade bodies these actually do care a bit more about complaints. You can make a complaint to their Chairman, Martin Leyshon martin.leyshon@hceoa.org.uk .

As for dealing with your debt I note 2 things, you say you have the means to pay the rest of the CCJ off and also that you never received the original documentation from the Court when the initial claim started. If this is the case then I would suggest you apply for Set Aside on the grounds you never received the original docs and were denied the chance to pay in full or defend. Your argument being you knew nothing until the HCEO turned up. This is applied for on Form N244 from HMCTS website - cost of application is £80. If granted and you can show you can pay the rest off then the CCJ will be wiped, and all enforcement will cease and any fees paid will have to be refunded.

If you cannot afford to pay then I would suggest you:
a - apply for a Variation Order - may not be granted as most business debts are all Forthwith
b - apply for a Stay of Execution against the HCEO using the grounds the costs are disproportionate to the debt owed, you cannot afford the fees charged

If necessary I can help with filling any of the Forms in.

Did you receive ANY pre-action correspondence, or ANY paperwork from the court before these 'agents' from HCC appeared ?

    Re: A joke

No one from the court has contacted me. No-one from HCC has contacted me nor the claimant. All were raised as complaints.
Should I go ahead with the OFT and anyone else. I cannot find from their paperwork that they belong to a trade body otherwise i would of done that as well.
