    hi there & thank you so much for any help, as I am truly sorry, but very suicidal over this

    Received a claim? yes, claim form from county court business centre
    Issue Date: 10/6/21
    Amount approx: £2280
    Claimant: Lowell portfolio ltd
    Solicitor: overdales solicitors
    Original Creditor: shop direct(very)/Capital one/vanquis
    Particulars of Claim: shop direct £164, capital one £101/Vanquis £1704
    Is the debt Statute Barred? no
    List any letters you have sent: just printed the cca & cpr to send off tomorrow

    Any Other Info: I have severe disability, mental health & learning difficulties, I am so sorry if any info I post isn't coherent as I really struggle with this type of information & have gotten into money trouble before, these were originally taken out in 2016 & I have had no other credit since due to problems with it.
    I really don't understand much of the information sent to me, but I have printed the letters from the first steps thread to go off to the relevant tomorrow, and also done the MCOL on line with acknowledgement of service & intent to defend.
    I understand this is money owed & the credit was taken out back when I was working, but since then health has & continues to deteriorate, with more hospitalisations on the way. in honesty this has spun my mental health into bad territory & I'm absolutely panicking about it all, ready to jump due to it.
    any information of what I need to do or how to defend myself as im a vulnerable claimant due to medical history, but totally acknowledge the situation, I just want to do the best possible to help the situation.

    you saying they are trying to combine an alleged debt

        ​​​​​​ CPR 31.14 Request only request copies of what is listed only on the blue N1 court form send proof posting to solicitors - ready to go you say.


        CCA Request ​​​​​​ with £1 postal order to each company get proof of posting and keep copies of everything on file

              First things first: Your health is extremely relevant to this situation. Can you urgently acquire a doctors summary letter stating the conditions you have and your inability to work.

              This is a relatively new account, so it is fairly likely that CCA documents will be provided, lets just assume they will so we can manage your stress levels.

              In my opinion, you need to URGENTLY contact Lowells 'Vulnerable Customers' team, I am presuming they have zero idea of your health problems?

              If you contact that team and send them proof of your medical history, they should stop the court case. They may want a Tomlin Order to pay off the debt in very small amounts over a long period, but even that would only be feasible if you can genuinely afford it. My advice is to be very direct with Lowell and under debt collection rules, they must treat you fairly.

              Please keep us informed and PLEASE don't let this worsen your health, they really aren't worth it. xx
