The answer to your question is no if it is that you have received a claim pack (blue claim form with response forms). If it's a General form of order or judgement the answer is still no and it's just a little more complicated.
Assuming it's a claim form firstly you need to acknowledge service and you should have a read of the First Steps.
Once you have read it post all the details back in this thread.

Restons has now taken the matter back to court.
I have to be honest I'm so stressed and worried about this now, I want to set up an affordable agreement with restons but have I left this to late now?

What's happened with the court between April and now ?
did you send CCA request / CPR request etc and acknowledge the claim as per the First Steps post that Jaguars linked you to? Then did you file a defence at all ?
Do you recognise the debt /account with Next ? Were default notice/assignment notice/ statements/agreements etc included in the SAR response ?
If you can give as much info as possible about where exactly things are at, we should be able to help you work out whether to try to settle or continuing defending the case.#staysafestayhome

Thank you for your quick reply, I sent the CCA & CPR request in April and about a month ago I received a SAR from Next with a full listing of items bought from 2009, default notice issued ect.
I don't want to defend this any longer, my anxiety levels can't take it... I'm worried this will go to court.
I should have dealt with this before but like most things that cause stress in my life I put in away to be dealt with on another day. (stupid I Know) Now I've received another letter from the court.

Is the court letter a directions questionnaire and letter about allocation ? There is a part on that form to opt for mediation which Id return before negotiating anything.
At at the moment you have received documents from the original creditor only - nothing from the claimant? Any sign of the agreement ? Whilst the claimant is in default of your cca request they cannot enforce the judgement. So you can wait and see if they do produce the original agreement or you can try and use their non compliance so far as a negotiating point to get a decent settlement discount.
any agreement you come to you want in writing before you make payment - they may want a consent order if you are paying instalments which would keep the case on hold in court while you pay and be withdrawn once settled. If you failed on agreed payments they could go back to the court for judgment.
How much is the debt ?#staysafestayhome
