OFT Test Case - as it happens

I arrived at the venue with no-one else in sight at 5am.

The IDRC is a smart modern building with a revolving door to reception with a sign boldly stating ''State of the art mediation'' an interesting concept.

I was issued a security pass for the day along with Stephen, Tom and Phil. We're back at the Leagle Beagles bunker chilling out before heading back to the venue for 10.00.

The passes are for the video feed retiring room which will have 2 x 40 inch screens. Rather amusingly the IDRC guy in charge of issuing the passes told us he had successfuly claimed back charges from HSBC.

I'll post an update when the hearing adjourns for lunch at one.

A Yorkies visit to the smoke- Part One

A thoroughly interesting day and many thanks to EXC for providing me with the opportunity to attend.

Departed from good old Yorkshire in the hire car around 5.30am, then a brief stop along the way to collect my hitchhiker.

Made good time straight down the M1 (surprising how fast a Vauxhall Astra will go when you are on a mission) and arrived at Brent Cross Tube Station around 8.53am according to the Day Travelcard. Arrived at Charing Cross some 1/2 an hour later followed by a mad dash to drop the bags with the concierge at The Strand Palace Hotel and make our way to the Courtroom 74 at the RCJ which EXC informed us was starting to fill.

Upon arrival at the RCJ, a beautifully feat of architecture, we passed through security(disappointed at the lack of strip searching involved) and made our way to the East wing in search of room 74. This must have taken a good 10 minutes due to the size of the place.

On entering the room we were faced with an almost packed array of Legal Teams for the banks, press and others. I caught sight of EXC, who was sat to the rear directly facing the Judges seat, and briefly greeted him before securing a seat to the right hand side of the Courtroom with Amethyst.

At this stage it was unclear as to how proceedings would follow and you could hear everyones speculation as to which way the decision would go.

The clerk asked everyone to switch off all mobile phones(maybe he should have mentioned Blackberries too) , didnt mention dictaphones though did he,ahem, cough.

    "All rise"............it was game on.

As Amethyst described, Judge Smith opened by thanking the parties for any amendments they had submitted to the Judgement. He then went on to explain how he would hand down the Judgement and asked that everyone should remain in the room until he had finished. After which we were all free to leave the room to make any calls and collect copies of the Judgement.

He continued to read out the conclusions of the Judgement word for word (paragraphs 449 and 450) taking all of 6 minutes. He then announced there would be a 10 minute recess to allow everyone to make calls etc.

Anyone would think the fire alarm had been raised as the scramble ensued to either collect a copy of the Judgement or leave the room to inform the world and his Aunty of the result. I managed to collect two copies of the Judgement, one I later gave to Tom Brennan.

Amethyst and myself then decided it would be in the best interest of Beagles if EXC were to remain for the remainder of the hearing(everyone thought Judge Smith would continue to read through the Judgement and allow replies from the OFT or Banks) and for us to rush back to the Strand to start scanning in the full Judgement and let everyone know the result.

As I was leaving the room Martin Lewis was being asked by someone `is this an outright win for us then` to which Martin said `YES, completely`. I could not resist correcting him by telling him it was not, but it was in fact only `largely` a win for us. He looked shocked and swiftly repeated to the young lad `Well yes, largely`........made my day that
