    The claimant had lost his claim against the bank, but resisted the amount of costs claimed.
    Held: The trial had been of a simple factual dispute, and the bank had failed adequately to disclose electronically held material in its possession. The bank had also, and despite having inhouse counsel, employed disproportionately expensive lawyers. The bank should receive only 25% of its costs claim. The court suggested that the bank’s difficulty might have been avoided by active costs management.As to documents held electronically, while there was no general obligation to retain such material, such an obligation did arise once proceedings were commenced.

      Below is extracted from the article and handy to know M - thanks. I'll also ask what the costs will be if it becomes necessary (not thinking defeat just yet).

        Please add GE Money (IGroup) and Advantage (owned by Morgan Stanley) their sub division for second charges was ADV2 (circa 200 of these accounts have now been sold onto Arrow Global) to the list of sub-prime lenders - all linked to Libor ....

          Shads, I know that Rooftop Mortgages (Sub Prime) bank with Barclays -so my guess they are all connected somewhere along the way especially with ther tie ups with the USA SPL's.

            FSCS cannot act on the "PPI" on the Kensington loan. TML stoped trading about 2006 but loan taken out pre regulation in 2005.

                My secured loans with Kensington initially mentioned the company name Money Partners ? can anyone enlighten me with the connection of the two companies? Does anyone know if Kensington used 'in house' brokers and what their names were?

                      Now that is a good question Shads,

                      We have Kensington Mortgage Company Limited and Kensington Mortgages Limited. The first is not on the register the second is.

                      I have asked KMC who my mortgage is with KMCL or KML, the answer Kensington!!!!

                        TML were also Money partners, Kensington changed it from MP to TML.

                            Okay, can someone help me out here. I get very easily confused TML, Money Partners, Kensington - are they all part of the same company? Who else is in the 'family'?
