I listened to that. Excellent talk from Kate but the response is shocking. I do hope the habit doesn't spread, it could kill consumer websites and honest reviews.

That's exactly why we were keen to publicise the issue. Section 5 of the Defamation Act 2013 (operators of websites) was well meaning in that if we follow the procedures it does give us more protection than before but section 5 notices are too easily abused by those that want to used them as crude tools for reputation mangement and in circumstances when it's patently clear that the complainant has no grounds or intention of issuing a claim in defamation.

Section 5 sets out the procedures for user generated content on 3rd party websites and the obligations of all 3 parties ie poster, website and complainant.

They made a threat to start legal proceedings almost 12 months ago but never followed it up with any action!!!

Says it all really!!!

They recently contacted the blog for a 'discussion' with us, but now they wont say a word!

To be fair, there is nothing they can say to justify their actions, but it would have been interesting to see what excuses they came up with!!

If you have all the evidence why write a blog about it, why not go to the tribunal board or escalate your complaint/case higher to expose their deception?

Completely agree EXC and their underhand activities should be exposed for what they are, but the blog has been rumbling on for over 12 months so why not file a complaint with the HM Courts & Tribunal Services or contact an MP 12 months ago? If what BEHINDPBS is saying is true they’d have been found guilty and the ripple effect would have been astronomical for them, potentially ground breaking in the sector.

Meanwhile if you read the MEN they’re showing off that they’ve just made £260 million in the past 12 months!
