              MET have sent the case studdy directly to me. It reads:
              Case Summery

              The charge notice w as issued as the vehicle did not clearly display a valid parking ticket/voucher/permit.

              This car park is a pay and display car park, locatednear a busy beach at southhend-on-sea (spelt incorrectly) Payment for parking can be made using the pay and display machines or the pay by phone service. There are 36 signs prominently dsplayedat the entrance to and around the car park representing approximately 1 sign for every 6 parking spaces. The main entrance sign measures 1200mmx800mm. 32 signs measure 600 mm x 800mm, 2 signs measure 400mmx600 an the final sign measures 750mmx1000. A key term of parking clearly stated on these signs is that payment must be made at the time of parking using the pay aand display machine or on your phone via the mobile phone service.

              On 22nd Aug 15 Veh was observed parked in the station pay & display car park not displaying a valid pay & display ticket.
              THe parking attendant checked the pay by phone service to see if ther was a valid parking session in progress at the time & there was not.

              At 1553 the parking attendant the parking attendant checked to see if there was a pay by phone parking session in progress at the time there was not then they issued a parking charge notice to the vehicle.

              As we did not recievean appeal to the parking charge ant the charge was not paid, after 29days we applied to the DVLA for registered keeper details. These were provided on the 22nd of sept as:
              The parking charge notice was sent to RK
              on 29th Sept Mrs Smith Appealed to Us as RK Stating that the Driver did not see the signs & the charge did not comply with the protections of freedom act.

              The appeals team investigates the case by reference to:
              -the terms & conditions of parking at that location, as stated on the signs prominently displayed around the car park
              -the particular term that vehicles must display a valid pay and display ticket in their windscreen at all times or use the pay by phone service to pay for their parking
              -the decision tree agree with our client

              on 5th Oct 15 our appeals wrote to mrs smith explaining that her appeal (letter which i have conveniently not received yet!!!) had been refused and stated:
              -the terms and conditions of use of the car park are clearly tated on the signs prominently displayed around the car park
              -Vehicles must clearly display a valid pay and display a valid pay and display ticket face up in front windscreen at all times
              -therefore the charge notice was issued correctly and we are upholding it

              She was also advised that to avoid future parking charge notices she should ensure she always check the signs & complies wit hte terms & conditions in place where they park.

              In her appeal to popla she states:

              1.He husband has been diagnosed with cancer recently & she cannot afford to pay the parking charge notice.

              We note Mrs Smith comments and if she had stated this in her original appeal to MET parking services Ltd she would have been offered a payment plan (WHY ARE YOU CHARGING DISABLED PEOPLE IN THE FIRST PLACE )
              to pay the charge at the discount amount of £60. As she has now appealed the charge at the POPlA the opportunity to pay the discount amount is no longer available at the costs with this charge have increased.

              MET parking provided a part payment procedure for those who may struggle to pay the charge in one sum. If Mrs smith wishes to arrange a payment plan to pay that outstanding amount she can do so by contacting customer services on 02070142666 mon-fri 10am-5pm.

              2. There was Limited Signage in the car park and she did not realise at the time she was parking that there were no concessions for dissabled badge holders. When she looked close at the sign she saw that the sign stated that there are no conncessions for dissabled badge holders.

              We note Mrs smiths comments, however we wish to point out that mrs smith was parking in front of a sign. The terms & conditions of use of the car park are clearly stated on the 36 signs which are prominently displayed at the entrance to & around the car park, these include that vehicles must clearly display a valid parking pay & display ticket face up in front windscreen at all times. please below for a photograph of mrs smiths vehicle in relation to a met parking service sign & a close up of a sign.
              (they have then put the pic of my car parked in front of the sign doh. & a blurry close up of the sign)

              Please note the sign clearly states there are no concessions for disabled badge holders.

              3. The vehicle was not improperly parked.

              The parking charge notice was issued was issued for failing to display a valid permit. it is the irrelevant to the issuing of the parking charge notice how the veh was parked.

              4. The amount on the parking charge notice in not correct.

              We note Mrs Smiths comment however the amount on the parking charge notice is correct. The amount stated on the parking charge notice is £100 discounted to £60 if paid within 14days. The signs state that by parking in this car park the motorist is entering into a contractual agreement & agrees to comply with the terms & conditions of use. they also state that the motorist accepts Liability to pay a parking charge of £100. (discountd to £60 if paid within 14 days) if they fail to comply with these terms.

              The terms & conditions of use of the car park are clearly stated on these 36 signs prominently at the entrance to & around the car parks, these incluse that vehicles clearly displaya valid parking pay & display ticket face up in the front windscreen at all times. The photographic evidence which can be seen in section 'E' Clearly demonstrates that no permit displayed in the vehicle when the parking charge notice was issued. In light of the above we believe the charge notice was issued correctly and the appeal should be refused.
              They go on the include pictures of the location & picuture's of the signs & my vehicle which has no ticket. copy of the ticked the letter i sent them the letter they sent to me which i have never received!

                          I don't know, phones are a mystery to me lol. People keep sending me piles and piles of PDF's instead of images so I assume phones put images as PDF's for emailing for some weird reason.
